Her Last Will and Testament

Death

Agnes, Lady Herries, died at Terregles on 14 March 1593-94. She made her will the day before; being "seik in body bot haill in mynd and saull," she desired to be buried beside her husband. After leaving legacies to her children, she took kindly thought for her servants and tenants. Not being "habill to writt" herself, she ordered Mr. Thomsoun, reader of the kirk of Terregles, to "subscryve" the will, which was confirmed at Edinburgh on 19 December 1598. 1 February 1549-50: Charter under the Great Seal of Scotland by which the Queen confirms possession of one third part of the lands and barony of Herries, one third part of the lands and barony of Teregles, and various other lands, to John, Master of Maxwell, and his wife Agneti Hereis, otherwise Agnes Herries, eldest daughter and one of the three heirs of the deceased William, Lord Herries. Agnes Herries had previously resigned these lands to the crown in order to obtain a new grant in favour of her husband and herself. RMS 1546-80: charter number 405

22 March 1561: Charter by which Archibald Herries of Madinpaup, identified as the male heir of the deceased William, Lord Herries, confirms that he has sold the lands of Reidcastle in the Stewartry of Kirkcudbright to Sir John Maxwell of Teregles and his wife Agneti Hereis, otherwise Agnes Herries. For greater security, it might be supposed, Sir John Maxwell of Teregles and his wife obtained a charter of confirmation under the Great Seal of Scotland on 17 August 1562. 6 October 1561: Charter by John Maxwell of Terregles kt (with consent of Agnes, Lady Herries, his spouse) in favour of John Irvine, grandson and heir of late John Irvine of Scalis, of the £5 lands of old extent of Scalis, in the parish of Ranepatrick [ie Redkirk], and the £5 lands of Woodhouselees, in the barony of Kirkandrews and parish of Canonbie. 8 May 1566: Charter under the Great Seal of Scotland by which the King and Queen confirm that they have incorporated the baronies of Teregles and Kirkgunzean into the free barony of Teregles for John Maxwell of Teregles and his wife Agneti Hereis. John and Agnes, who had previously resigned these lands in order to receive a new grant in their favour, were to hold the new barony in conjunct fee and liferent. RMS 1546-80: charter number 1728

20 February 1577 and 26 February 1577: Charter by which William Baillie of Lamington, with the consent of his wife, Lady Margaret Maxwell, Countess of Angus, confirms that he has given the lands and barony of Lamington, together with other lands, to his daughter Margaret Baillie and her husband Edward Maxwell. His gift follows from a contract between John, Lord Hereis, his spouse DOMINAM AGNETAM HEREIS, and their son Edward Maxwell, on the one part, and William Baillie of Lamington and his wife Margaret, and their eldest daughter Margaret Baillie, on the other part. Edward Maxwell and his wife Margaret were to hold in conjunct fee and liferent. William Baillie of Lamingtom and his wife Margaret reserved their own liferent. For greater security Edward Maxwell and his wife Margaret obtained a charter under the Great Seal of Scotland on 2 March 1577-78. RMS 1546-80: charter number 2780
