Testator’s first marriage

The testator is said to have married firstly Anne Empson, the sister of Sir Richard Empson (c.1450–1510). See Betham, William, The Baronetage of England, (Ipswich: Russell and Bransby, 1801), Vol. I, p. 87: GoogleBooks

In the will below the testator mentions a son and two daughters:

1. Thomas Spencer (d.1532), who was about six years of age in 1499, the date of th inquisition post mortem taken after the testator’s death.

2. Jane Spencer (d.1526). According to some sources she was the daughter of the testator by his first wife, Anne Empson.

3. Elizabeth Spencer, [by 2nd wife?] who was less than 14 years of age when the testator made his will. She married Sir John Greville (d. 25 November 1547), the eldest son and heir of Sir Edward Greville (d. 22 June 1528) of Milcote in Weston on Avon, Warwickshire,

  • stated by Lee to be son of Henry Spencer, of Badby, co. Leicester (d. 1476) (by his wife Isabel Lincolne, dau. (and hrss.?) of Henry Lincolne), son of Thomas Spencer, of Defford, co. Worcester, son of Nicholas Spencer, of Defford, co. Worcester (by his wife Joan Pollard, dau. of Richard Pollard), son of John Spencer, of Defford, co. Worcester (by his wife Alice Deverell, dau. (and hrss.?) of Giles Deverell), son of William Spencer, of Defford, co. Worcester. He died in 1330 and his IPM held at Pershore, co. Worcester, shows him holding a messuage, four virgates of land and two acres of meadow in Defford by socage, i.e. rent, from Geoffrey Dabitot. Despite the pedigree drawn up in 1595 by Richard Lee, Clarenceux King-of-Arms, for Sir John Spencer, this William Spencer was not the son by his second wife of John le Despencer, of Martley, co. Worcester, who died in 1275. John's IPM that year (Chancery Inquisitions 3 Edward I No 2) quite clearly shows that as he had died without surviving issue he was succeeded in his estates by his relative Hugh le Despencer, son of his cousin the famous Hugh le Despencer, Justiciar of England. There is no historical evidence other than Lee's pedigree of John le Despencer having a second wife.
