Benjamin Shaw son of Roger and Ann (___) Shaw, was born at Cambridge, Massachusetts in July, 1641. [1]

In his father Robert Shaw's will, written on August 25, 1660, he names his son Benjamin, among others. And it a codicil, written on March 20, 1660/1, made changes in directing his bequests and which children, including Benjamin are to pay their siblings from their inheritance. [1] [2]

Benjamin married Esther Richardson at Hampton, New Hampshire on May 25, 1663. Esther, was born about 1645, origins and parents are unknown. [1]

He died at the age of 76 at Hampton on December 31, 1717. His will was written on December 27, 1717 and proved on February 12, 1717/8. [1]

In his will he names the following: [2]

• wife Esther
• my daughters, Mary, Esther, Sarah, Abigail and Hannah, all that I have already given them, plus L 3 each to be paid by their brothers
• sons Benjamin, Roger, Joseph, Edward and John wife Esther and son Edward to be executors [2]

Esther died on May 16, 1736 aged 91. [1]

WILL OF BENJAMIN SHAW Youngest Son of Roger1 Shaw, of Hampton, N. H.

IN THE NAME OF GOD, AMEN. I, Benjamin Shaw of Hampton, in the province of New Hampshire in New England, being at this time of perfect understanding and memory, though often sick and weak in body, committing my soul to the hands of Almighty God and my body to decent christian burial in hopes of eternal life etc., do thus dispose of my temporal estate which God hath given unto me.

FIRST. My will is that my honest and just debts be duly paid in a convenient time after my decease.

SECOND. I give and bequeath unto my daughters, viz: Mary, Esther, Sarah, Abigail and Hannah, all that I have already given them, with the addition of three pounds to each of them, to be paid in convenient time after my decease by my sons, viz.: Benjamin to pay to my dau. Mary, three pounds; Roger to pay to my dau. Esther, three pounds; Joseph to pay to my dau. Sarah, three pounds; Edward to pay to my dau. Hannah, three pounds and John to pay my dau. Abigail, three pounds.

THIRD. I give and bequeath to my beloved son Benjamin Shaw, the land where he now dwelleth; and also my share or lot in the "West Division," and one half of my marsh lying at the Steep Bank, to have his half at the upper end; and one half of my marsh land lying by goodman Cliffords, to have his half on the south west side; and one half of my little meadow lying on the west side of the "great causeway"; and one lot on the 2d West Division, as also one half a share in the "cow common."

FOURTH. I give and bequeath unto my son Roger Shaw, my forty acre lot lying at a place called "Bride Hill" where he now dwelleth; also one quarter of my marsh at the "Steep Bank," to lie next to my son Benjamin's, above said; and one half of my meadow lying by goodman Cliffords; and one half of Little Meadow lying on the west side of the "great causeway"; also one lot in the 2d "West Division"; and one share in the "cow common."

FIFTH. I give and bequeath unto my beloved son Joseph Shaw, the land bought of Samuel Fogg, the "lot orchard", and eight acres of pasture land; one share in the great "ox common", and my meadow at the "great pond"; also three shares at the Little River Marsh lying upon the south side of "Fifield's Island"; one half the land bought of Joseph Cass and John Dow; one half of my meadow bought of John Page, to have his half next to the upland; also two acres of the marsh bought of Thomas Ward, to have it on the south side; one lot in the 2d North Div., and one share in the "cow common".

SIXTH. I give and bequeath to my beloved son John Shaw, my lot lying at a place called "The Temple" lying on the westwardly of John Sanborn's land; also one half of the land I bought of Capt. Cass and John Dow; also the marsh I bought of Thomas Ward, except the two acres given to my son Joseph above said; and half the meadow I bought of Isaac Godfrey, and the meadow I bought of Thomas Veasey lying at the Temple meadow; my lot I bought of Capt. Green, and half a share in the "cow common".

SEVENTH. I give and bequeath unto my son Edward Shaw, my homestead, both land, buildings and orchards, my home lot and pastures with the meadow I bought of John Sanborn, and half the meadow I bought of Isaac Godfrey; one quarter of my marsh at the "Steep Bank," at the end next the sea; my meadow at the Town Bridge, so called; also my lots or share in the "West Division" lying near Saml Helies; also my lot I bought of Samuel Marston, called the 2d No. Division; also my lot I bought of Nehemiah Hobbs at "Bride Hill," with one share in the "cow common"; all my instruments and utensils for husbandry; three quarters of all my stock, of what sort or kind soever, with all my debts due to me at my decease; and one half of all my money, chattels, household goods within doors or without. And I order him, my son Edward to pay to Sarah, dau. of my daughter Ruth Shaw, the sum of three pounds.

EIGHTH. I give and bequeath unto my beloved wife, Esther, the one half of my money, the one half of my household goods, and one quarter of my stock of cattle of what kind or sort soever, with the improvement of my largest room, and the chamber and cellar during her natural life, if she have occasion for so much room etc.

NINTH. And my will is, that my son, Edward Shaw, shall take care of and provide for his mother, my dear wife Esther, during her widowhood, that he shall provide her firewood, meat drink and attendance, suitable both in sickness and in health, as she shall have occasion; which if my said son Edward refuse or neglect to do the same, my said wife shall have liberty to improve and possess the one third part of all my lands, and the one half of all my stock and household goods for her support and maintainance during the time of her widowhood, as aforesaid.

TENTH. My will is, that what debts shall be owing from me at my decease, and also personal expenses, shall be paid by my aforesaid sons, in equal proportion: and whatsoever lands or estates I have given unto my sons, my meaning is, that I have given and bequeathed unto them, their heirs and assigns forever: and if any lands, or any rights to lands, belonging to me, be not herein mentioned, I give them to my son Edward, forever to be at his disposal: and if there be anything or things movable or estates not herein mentioned, I give the same to my executors to be equally divided among them.

ELEVENTH. I do ordain and appoint my wife, Esther, and my son Edward, executors to this, my last will and Testament, and in confirmation hereof, I have hereunto set my hand and seal this 27th day of December, Anno Domini seventeen hundred and seventeen, (1717) in the third year of king George, his reign over Great Britain.

This Instrument was signed by Benjamin Shaw, and sealed by him with his seal, and declared by him to be his last Will and Testament in the presence of us as witnesses, namely:

Gravesite Details

Folsom and Goss say the stone reads 1713. The genealogical section of Dow's History of Hampton says it is 1718. Town records state specifically that he died December 31, 1717.
