"The youngest son of Richard and Elinor (Browne) Warfield was Benjamin [...] He married Elizabeth Duvall, daughter of Captain John and Elizabeth (Jones) Duvall [...] One son, Joshua, and a daughter, Elizabeth, were their issue. Benjamin Warfield died in early manhood, in 1717, leaving his two children minors. His widow married John Gaither, the second, who administered." (J. D. "In the name of God amen the Twenty Second Day of March in the Yeare of our Lord one Thousand Seven hundred & Seventeen I Benjamin Warfield of Ann Arundel County although Sick in body yet of Sound & perfect memory praised be God therefore doe make this my last will & Testament in Manner & forme following that is to Say First I bequeath my Soule to the Almighty God that gave it & my body to the earth to be buryed in Such Decent Manner as it Shall please My Execs hereafter mentioned to think fitt & as touching My worldly Goods my will is that it Shall be disposed off in Manner & forme following First I will that all Such Debts that I justly owe to any persons Shall be duely payd by my Exec_______ Item I give & Bequeath to my Son Joshua Warfield my dwelling Plantation whereon I now do live & all my Land thereunto Belonging to him & his heires & assignes forever_______ Item I give & Bequeath to my Said son Joshua Two hundred & forty acres of Land being part of a tract of Land Called Warfields Ranges lying near the falls of Patuxant River to him his heires & assignes Forever_______ Item I Give & Bequeath to my Daughter Elizabeth Warfield one moyety or halfe part of a tract of Land called Winkapin Neck to her her heires & assignes forever_______ Item My will is that if either of my Children Should Dye without Issue that then the Survivor Shall Inherit all the aforementioned Land & if please God both my Children Should dye without Issue that the [sic] my Will is that my part of Winkapin Neck Shall be equally divided between my Brother Richard Warfields three Daughters namely Ruth, Rachell, & Lydia Warfield & to their heires & assignes forever_______ And my two hundred & forty acres of Land tract of Warfield's Forrest to be equally divided between my Brother Alexander Warfield's two Daughters namely Rachell & Sarah Warfield & their heires & assignes forever_______ Item I Give & Bequeath to my Brother Richard Warfield one moyety or halfe part of a tract of Land Called Benjamins Discovery to him his heires & assignes forever_______ Item I give & Bequeath to Mary Yate one Cowe & Calfe to be p'd her after the age of Sixteen Years_______ Item I constitute ordaine appoynt my well beloved wife Elizabeth Warfield & my loving Brothers Richard Warfield & Alexander Warfield to be my whole & only Executors of this my last Will & Testament but my will is that my wife Shall have my whole estate in her hands as long as She Shall manage it Carefully without Embezelment, but if my Execs. shall see that my Childrens estate Shall be like to be wasted or Destroyed then my will is that my Execs shall take Care of my Children's part of my Estate not otherwise. And I doe hereby make voyd all other will or wills by me heretofore other made or declared either by word or writeing & this only is to be my last will and Testament & none other In Witness whereof I have Sett my hand & affixed my Seale the Day & Yeare first within menconed_______ Benja. The foregoing will was thus endorsed June ye 24th 1718 Then Came Mr. Caleb Dorsey & Dr. John Rattenbury two of the Subscribing evidences to the above within will and made oath upon the holy Evangelists of almighty God that they heard him publish & Declare the above & within Instrument of writing as his Last will & Testament that at the time of his Soe doing he was to the best of their apprehension of perfect Sense & memory Jurat Cor [sworn before me] Benj.
