From New Mexico Prenuptial Investigations from the Archivos Historicos del Arzobispado de Durango, 1800-1893, ed. Rick Hendricks, comp. John B. Colligan (Rio Grande Historical Collections, New Mexico State University Library, 2000), Pg. 18:

Bernardo Valdez, 64, espanol, was the widower of Maria Beatriz Salazar and citizen of the Abiquiu jurisdiction. Maria Gertrudis Sanchez, 39, espanola, was the widow of Antonio Vicente Martin and citizen of the Abqiuiu jurisdiction. The Couple was related in the second degree of affinity because Gertrudis Sanchez had engaged in copula illicita (illegal sexual relations) with Igancio Valdez, Bernardo Valdez's nephew.

Bernardo Valdez told Father de la Prada that he had always lived in the area and that he was not Gertrudis Sanchez's blood relative. They were related by affinity in the second degree because of her illicit relations with his nephew, Ignacio Valdez, which he did not know until he asked Gertrudis to marry him. He had had sex with Maria Gertrudis on numerous occasions, which had resulted in her becoming pregnant, before he knew of the impediment.

Witnesses:

  • Alonso Martin, 60, citizen of the Abiquiu jurisdiction
  • Joaquin Naranjo, 58, citizen of the Abiquiu jurisdiction
  • Juan Martin, 81, citizen of the Abiquiu jurisdiction
  • Jose Chacon, 70, citizen of the Abiquiu jurisdiction

Father de la Prada stated that although the couple had known each other carnally, it was not done to facilitate a dispensation. They were unaware that Ignacio Valdez was Bernardo's relative when they had sex. They were seeking a dispensation from Vicar Ortega, to whom proceedings were forwarded from Abiquiu on 12 Apr. 1801. That dispensation was granted on 16 Apr. 1801.

Father de la Prada wrote another note to Vicar Ortega on the 12th in which he stated that he had received notice from Pablo, the son of Gregorio Vllapando, stating that the impediment was in the third degree and that the copula illicita did not extend beyond the second degree.

In Durango, on 19 Oct. 1801, Bishop Olivares y Benito revalidated the marriage.
