About Capt. John Robert Ezra Cate, Jr.

CANE CREEK BAPTIST CHURCH-ORIGINAL TRUSTEES Robert Cate had six sons, four of whom came to Orange County. Two, Captain Robert Cate, Jr. and Thomas Cate settled along Cane Creek. Robert's line produced five of our trustees (sons Richard, Thomas, and Joseph, son-in-law John Strother, and grandson Robert, a son of Thomas. Thomas' line produced three trustees, sons Thomas (the preacher) and Bernard, and son-in-law John Workman. To complete the family connections, the grantor, Thomas Durham, was married to Robert's granddaughter, Susannah (daughter of Thomas). Below is what we know about them. PROFESSIONS: Robert CATES, Jr. was Commissioner of Roads in Orange County, North Carolina. He was known as "Captain CATES."

PROPERTY: He lived on the Roanoke River in the 1740s; then at New hope Creek; and then at Cane Creek by 1751.

This Indenture made this twentieth day of August in the year of our Lord one thousand seven hundred and eighty-nine. Between Thomas DURHAM of Orange County of the one part and Thomas CATE preacher, Thomas CATE, Robert CATE, John STROTHER, Richard CATE, John WORKMAN, Bernard CATE, Joseph CATE, Mary CHRISTMAS {#33} jointly Trustees of Orange County of the other part. Witnessed that for and in consideration of the sum of twenty shillings North Carolina currency to the said Thomas DURHAM in hand paid by the said Thomas CATE preacher, or either of the above mentioned Trustees at or before sealing and delivery of these presents the receipt whereof he doth hereby acknowledge and therefore doth release acquit and discharge the said Thomas CATE preacher, or either of the mentioned trustees them or their hairs, executors and administrators by these presents he the said Thomas DURHAM hath granted, bargained, sold, allied and confirmed and by these presents doth grant, bargain, sell, allien and confirm unto the said Thomas CATE preacher and the rest of the above mentioned names of the trustees jointly they or their heirs a certain piece or parcel of land situate, lying and being in the county of Orange and state aforesaid for the use of building a meeting house to hold public meetings in and thanksgivings for the Measures and Blessings of Almighty God. Bounded as followeth:

Beginning at a black oak at the old path joining John STROTHER's line then along the old path to a hickory adjoining STROTHER's line thence east along John STROTHER's line to a post oak thence a direct line to the beginning containing one acre more or less and all houses, buildings, ways, water, profits, hereditaments and appurtenances whatsoever to the said premises whereby granted or any part thereof belonging or in anyway appertaining and the reversions and reversion, remainders and remainder, rents, issues and profits thereof and forever to him the said Thomas DURHAM of in and to the said premises and all deeds, indentures and indentures touching or in anyway containing the same.

To have and to hold the land hereby conveyed and all and singular other the remise hereby bargained and sold and every part and parcel thereof with their and every of their appurtenances unto the said Thomas CATE preacher, Trustees and the rest of the above named trustees all jointly them and their heirs and assigns forever to the only proper use and behoof of him the said Thomas CATE preacher, trustees and the rest of the above names Trustees all jointly named and heirs and assigns forever and the said Thomas DURHAM covenant and agree that I have absolute authority to grant and convey the same to the above trustees in manner and form aforesaid.

Will

Robert left his wife, Elizabeth, half of his estate. He left to his son, Richard, the plantation where he lived at his death after the death of his mother. To his daughter, Sarah, he left the bed she slept on. His granddaughter Ann, daughter of his son Thomas, was left an equal part of his estate as received by his sons and daughters.

His sons, Thomas and Joseph were named executors. He did not mention his other sons, Robert III, John, or Charles.

1720 Nicholas Wyatt of "Merchants Brandon Parish", Prince George County, VA, signed his will. he named as legatees Elizabeth Wyatt, daughter of Anthony. Granddaughter Frances Wyatt; granddaughter Sarah Wyatt; grandson John Wyatt; Nicholas Reeks, son of daughter Susan Reeks, decd; and son Edward. Witnesses: Robert Cate Jr., Richard Cate and John Hamersley.

1725 Elizabeth's father, Edward Wyatt Sr, named his daughter and mentioned the plantation where Robert Cate lived.. Martins Brandon Parish, Prince George County: Edward WYATT Sr.'s Will named daughters Elizabeth and Sarah Wyatt, son Francis and son Edward to whom "he left the plantation where Robert Cate lives".

Edward's father, Nicholas's Will was witnessed by Robert CATE, Jr.

1741 Northampton County was formed from the western part of Bertie County and Edgecomb district became Edgecomb County. The Roanoke river was the dividing line.

1745 Northampton County Deeds, 7 Sep 1745 Aaron Fuzill to John Arnal, 100 acres on Roanoke River, joining the mouth of Little river, Robert Cates and the mouth of Orter branch. Wit: S/John Weaver, S/William Arnoll. (Orter branch is Arthurs branch) Thomas Cate son of Robert Cate Jr. married Elizabeth Fussell, daughter of Aaron.

1745-1746 According to Dr. Banks Cates, Jr., Capt. Robert Cate Jr. moved from the Roanoke River North Carolina to Sandy Creek, Granville Co. and then to New Hope Creek.

1750 Land entry in Bladen County in the Earl of Granville's District for Robert Cade, 400 acres "begg on the south side of new Hope Creek. Rung down the Creek for Complemt". 24 Oct. 1750 Item #1260.

1751 Survey for Robert Cate, 400 acres in Bladen County, on both sided of New Hope Creek. Chain Bearers: Thomas Cate and Reubin Brown. surveyor: Richard Caswell. 18 Feb 1750/1.

1752 Orange County was formed from parts of Granville, Johnston and Bladen Counties. The first Court of Orange County was held at the home of John Gray on the Eno river, just above the confluence of McGowns Creek, 9 Sep 1752.

1755 Warrant to Richd Owen, 640 acres on both sides of Cain Creek; about 1 1/4 miles above Capt. Cates. 26 Feb 1755. entered 4 Jan 1755. Assigned to Robert Cate. Surveyed for 560 acres 22 Sep 1756. Deed 5 Aug 1760.

1755 Meeting of the Commissioners of the Road: Joshua Stroud, George Smith, Thomas Cate, Jr., Richard Owins & Edward Carter to work under the inspection of Cap't Robert Cate.

1756 Meeting of Commissioners of the Roads: "a list of present Commissioners of Roads" included Robert Cate, Rob't Cate fined 30 shillings, Josiah Hadley Overseer from the Court House to Mary Williams' Fording over Haw River & that the following Tythables work on the said road - John Hadley, John Marshal, William Johnson, Charles Johnson, John Johnson, Mathew Woods, Thomas Cate, Jr., Thomas Cate, Sr. Robert Cate Jr. & Cap't Robert Cate, Joseph Cate, Robert Wiley, Wm. Roseberry & Edw'd Davis. 26 April 1756.

1756 Survey for Robert Cate, 560 acres in Orange County on the North side Haw-river opposite to ye mouth of Terrels Creek. Beginning at James Collins corner by sd. river. Then running along his line of Collins Creek. Then to Haw-river. Then up the various curles of the river, and including the Island opposite to ye mouth of Terrels Creek. 1760 Earl Granville to Robert Cate, of Orange County, Planter, 560 acres in St. Mathews Parish, on the north side of Haw river, opposite to the mouth of Terrels Creek. sealed and delivered in the presence of Jas. Watson & Thomas Cate, June'r. S/Robert Cate, 5 Aug 1760.

1761 Orange County Court of Pleas and Qtr. Sessions: Robert Cate, Sr. to Isaac Cantril, 280 acres. Ack by Robert Cate 10 Nov 1761.

1762 Warrant to Solomon Dixon, 700 acres on Haw river and Terrils Creek. "No land to be found is being taken by Robt. Cates - John Lea. " "Entry money returned by James Watson". 27 Jan 1762.

1763 Robert Cate, Sr. exempted from taxes at the Court House in Corbintown. (The name of the county seat was changed to Hillsborough in 1766.)

1763 Orange County Ct. of Pleas & Qtr. Sessions: Robert Cate's mark was recorded 3 May 1763.

1764 Orange Co. Ct. of Pleas & Qtr. Sessions: Robert Cate was appointed a member of the jury to lay out a road from Isaac Lowe's mill to Alexander Mebane's mill, and from thence to Woody's Ferry on Haw river, along with Thomas Cate Sr., Thomas Cate, Jr. and others February 1764 Court.

1765 Robert Cate of Orange County signed his will 5 Nov 1765. He named his wife Elizabeth and left her half of his estate. He left to his "son Richard the Plantation wheron I now live after his motheris Deceased" He left to his daughter Sarah "the bed wheon she know lyes. " He gave his "gran Daughter Ann, the daughter of my son Thomas for to have and equal part of my estate with my sons and Daughters". He named his sons Thomas & Joseph to be executors. Wit: William (X) Smith and Eliz'a (X) Cate. S/Robert Cate Sen.

Robert probably had other daughters as he stated in his will that "Gran Daughter Ann, to have equal part of my estate with my sons and Daughters." Robert didn't name his sons Robert Jr.(III), John or Charles. (Dr. Banks Cates) (My designation for Robert Cate son of Robert Cate Jr. is III. RBP)
