Biography

John Wayte, son of Samuel and Mary (Ward) Waite, was born about 1618[1] at Fitchingfield, Essex, England. He either accompanied, or followed his father-in-law, Joseph Hills to New England who arrived aboard the Susan and Ellen out of London, England. He was the son of Samuel Wayte of Weathersfield, a town about 18 miles from Malden, Essex, England.[2]

John was one of the early settlers of the Mystic side of Boston afterwords known as Malden. In 1644 he was a member of the Charlestown Church and in May 1647 he made Freeman.

In 1650 he married Mary Hills the daughter of Joseph and Rose Hills from Great Burstead, Essex, England. Children of John and Mary Wayte were who were recorded as being born in Malden:

In 1666 John succeeded his father-in-law Joseph Hills Sr., in the House of Deputies. In 1675, during King Philip's War he took command of a company in active service. in 1684 he was chosen Speaker of the House of Deputies, and soon became deprived of his sight which resulted in him retiring from public life.

Mary Hills Wayte died in 1667 and John married second Sarah, widow of Jacob Parker on 4 Aug 1675 at Malden.[3] John and Sarah had no natural children.

At age 74 years John Waite of Malden was deposed in the year 1692/3. Recorded in the 'History of Malden, Massachusetts': For over thirty-four years of all the early settlers of Malden, two men stand out in the prominent positions held: Joseph Hills, Sr. and son-in-law John Wayte.[4]

Captain John Wayte died 26 Sep 1693 at Malden, Middlesex County, Massachusetts. He was buried at Bell Rock Cemetery, Malden.

Research Notes

n one source, John Waite is shown with a marriage to Mary (Green) (abt.1633-); it is sourced by the work of Samuel Greene who thinks Mary was born about 1633 to father Thomas Green; however, the author's unsupported contention is very questionable. First, there is no baptism record for Mary circa 1633 in the same parish where her siblings were baptized. Second, Torrey in New England Marriages to 1700 shows John Waite marrying Mary "Hills" (daughter of Joseph) NOT Mary Green, by 1656. He cites:

Samuel Stillman Greene asserted (without source) that Thomas' daughter Mary was born "about 1633" in England and that she then married Captain Thomas Waite of Malden before 1656.[6] While this age would work, that marriage according to Torrey in "New England Marriages to 1700" was not to Mary GREEN but to Mary HILLS, daughter of Joseph and that she died in 1674.[7] (citing Warner-Harrington 642; Reg. 24:103, 26:82, 28:89, 31:161, 32:189, 51:299, 301, 57:196, 94:221; Snow-Estes 1:216, 217, 238, 273, 2:235 among others). Torrey's sources and Samuel Stillman Greene clarify that when Thomas Green referred to John Waite as his "brother" in his (John Green's) will, it was the common usage meaning "brother-in-law". Thomas Green "jr" married Rebecca Hills, daughter of Joseph and Rose. Rebecca Hills seems to have been sister or half-sister of Mary Hills. Mary Hills was wife of John Waite, thus Thomas Green "jr" and John Waite were brothers-in-law (at a remove).

Biography

NEHGR Vol. XXVI: His father-in-law came over on the Susan and Ellen of London in 1638. He and his father-in-law were leading men in the settlement of Malden and together represented the town in the house of deputies for a period of thirty-four years, both attaining the speaker's seat.Deputy to the General Court 1666-1684. In 1684 he was Speaker and in 1685 he was excused from further service due to his age and blindness.

Waite: John Waite was born about 1618 and accompanied or followed, to New England, his father-in-law, Joseph Hills, who came in the "Susan and Ellen" of London in 1638; and was one of the early settlers at Mystic Side (afterwards Malden), where he purchased a house and land of widow Martha Coytemore in 1644; member of the Charlestown church 1647, and made a freeman in May of that year. In March, 1647-8, the colony allowed him 4 pounds 18 shillings "for his writing one booke of the lawes, and for finding paper for both bookes." This was the manuscript of the celebrated Massachusetts Laws of 1648, compiled and perfected by Joseph Hills, the first body of laws established by authority in New England.

After the incorporation of Malden, in 1649, he became a leader in its civil and religious affairs; was a stout supporter of the Rev. Marmaduke Matthews in the strife which followed his unhappy settlement; was clerk and selectman for many years, captain of the trainsband, and commissioner to end small causes. In 1666 he succeeded Joseph Hills in the House of Deputies, and continued to represent the town during a period of eighteen years.

In 1675, during King Philips's War, he was ordered to convey a detachment to the rendevous of Major Pynchon at Marlboro; and in certain contingencies, he was to take command of a company in active service. In 1680, he was appointed a member of teh committee to revise the laws, with which his labor in 1647, and his long experience as a legislator had doubtless made him familiar. He was identified with the popular party, and was one of the "faction" denounced by Edward Randolph in his "Articles of high Misdemeanor.

" In 1681-2, with Deputy Governor Stoughton and others, he was chosen to prepare papers for the agents in England, and "to do therein as in their wisdome they shall see meete for the end proposed," and was a member of the committee to correspond with and to provide for them; and in 1683 he received a nomination to the Magistracy. In 1684 he was chosen Speaker of the House of Deputies; and becoming deprived of his sight, soon after retired from public life.
