About Capt. Timothy Peyton

Capt. Timothy Peyton (c1746-1787) was a prominent citizen and early settler in Kentucky. He served as member of the Virginia Legislature from Fayette County (1783).

On 22 May 1770 his father gave him £20 and a tract of land in Fauquier County, Virginia on the branches of the Little River. This land was part of a tract granted to Thomas Thornton of Lancaster County and devised by Thornton to his daughter Ann Thornton, wife of Henry Peyton and mother of Timothy Peyton.

Some sources also place him in Stafford County, Virginia, where his father was born.

He served in the American Revolution. He received a Virginia Military Land Warrant as heir-at-law of his brother Capt. Valentine Peyton, who served three years in the American Revolution.

"William Foster and Sarah Hart were married in the spring of 1783 in Prince William Co., VA. The following spring William sold his land, formed a packtrain, and migrated with a neighbor Timothy Peyton to Bourbon County, Kentucky. They lived on the Will Thomas station until their first child was born then joined Timothy at his new station. In 1787, Timothy Peyton was scalped by Indians. William Foster organized a search party to recover and bury the body. William and Sarah remained to help the widow Peyton until 1805."

Timothy made his will 5 September 1782. It named wife Sarah, and children Sitha Ann, Ann Thorton, Francis Elizabeth, Valentine Smallwood, and an unborn child. His will also mentioned his brother Valentine Smallwood and his brother-in-law James Matson's child. Executors: wife, James Matson, John McMillan. Witnesses: Jesse Davis, John Davis, George Jackson and Thomas Calvert. His will was probated 17 January 1788 in Bourbon County.

"Fauquier Co. court, 27 May, 1834. Certified that Valentine Peyton who was a Captain in the Rev. war, left at his death no children, and that Timothy Peyton, who was his elder brother, was his heir at law. That said Timothy died about the year 1786 or 87, leaving the following children: -- Scithia (who married Archibald Marshall), Nancy (who married William Mallow), Frances (who married Baylis Grigsby), and Valentine S. Peyton.

"That Archibald Marshall has since died, and that Frances Elizabeth (Peyton) Grigsby has also died leaving only one child, namely, Sally, who has married Alfred Rector; that Sally and her husband are both living in Fauquier Co., Va. Copy teste, A. J. Marshall, Clerk."

"Know all men by these presents that we the undersigned: Valentine Peyton of the county of Clay, Missouri and Anna Mallory (two of the children of, and heirs of Timothy Peyton, decd, who was the only heir of Captain Valentine Peyton, decd.) of Bourbon County, Ken. have appointed William H. Todd of Frankfort, Ken. our Atty. Signed by Val. S. Peyton and Ann T. Mallow, 3 Dec., 1835. Ackn. before John Bird, J. of P. Clay County, Mo. Attest, William T. Wood, Clerk of Clay Co. court."

"Ann T. Mallory personally appeared before E. Thurston, J. of P. Bourbon County, Ken. and Ackn. the above power of Atty. 28 Jan., 1836. Attest, James T. Morehead Lieutenant and Acting Governor of the Commonwealth of Kentucky."

"Warrant 8400 for 139 acres issued to Scythea Marshall; warrant 8401 and warrant 8402 each for 139 acres issued respectively to Nancy (Anna) Mallory and Valentine S. Peyton. 4 Mar., 1836. Recorded Book 3:419, Va. L. Off. [Virginia Soliders of 1776, p. 147.]"

"29 June 1792 Concerning property of Timothy Peyton, Bourbon County, who died "some time in the year of our Lord one thousand seven hundred and 87." Trustees appointed: James Garrard, John Allen, John Walker."
