About Charles Kay

Charles Kay was the son of James Kay and Grace Elgin Kay and born (perhaps) in Virginia or at the James Kay homeplace in Ghentsville, Abbeville County, SC. In 1850 and 1860 census records he gives his birthplace as Virginia. The 839-acre plantation on Beaverdam Creek where the Kay Family Cemetery was situated was called "Beverdam" in Anderson County Deeds, Vol. W, p. 336.

Mary Johnson Kay was the first wife of Charles Kay (1790-Sept 2, 1867), who is buried next to her with a separate marker -- he was married secondly to Charlotte Miller Kay, a granddaughter of the famous English printer, John Miller, who moved to Charleston and later to Pendleton.

Mary Johnson Kay was the daughter of Benjamin Johnson and Elizabeth Gaines. The children of Charles Kay and Mary Johnson were: James Harrison Kay, Hilyard Kay, Theresa E. Kay, William Marvin Kay, Enoch Henry Kay, Louisa C. Kay, Caroline E. Kay, Charles Wesley Kay, Silas E. Kay, Eldred Johnson Kay, Marcus Moore Kay, and Margaret Pendleton Kay.

At the time of Charles Kay's death his widow Charlotte Miller Kay got 1/12 of his estate as well as all property she owned when they married, and his eleven children (with Mary Johnson Kay) each got 1/11 share of the estate. Three of the children are said to be buried in the Kay Family Cemetery, along with certain in-laws.

The son of James Kay and Grace Elgin, was born 19 Dec 1790, perhaps in VA. He possibly was born on the James Kay home place in Ghentsville, Abbeville Co., SC; however, in the 1850 and 1860 census records of Anderson Co. he gives his birthplace as VA. His birth and death dates are on his tombstone. Charles married Mary Johnson, born 10 Jan 1797, the daughter of Benjamin Johnson and Elizabeth Gaines. He is listed on the 1830 census of Abbeville Co. in the age group of 30 to 40, along with his wife and eight children. It is not known where they spent the first twenty years of their marriage, but on 2 Jun 1839 Charles Kay bought 838 acres on Beaverdam Creek in Anderson Co. This large tract was described in the deed as the "plantation known as Beverdam." It was located on one of the early roads of old Pendleton District, which led to the county seat at Pendleton. This land remained in the Kay family for several generations and on it is located the Charles Kay family cemetery. The cemetery is located about one mile northwest of Whitefield church in Anderson Co. on Breazeale Road. In this cemetery rests Charles, his wife Mary Johnson, three of his children, some in-laws, and some non-relatives. A total of some 12 readable tombstones still stand along with perhaps 20 unmarked depressions with field stones, possibly the grave sites of slaves. During the 1850s several of Charles Kay's children moved west. Most of them initially settled in Alabama and Mississippi, but many eventually moved further west to Texas and Oklahoma. It is said that when Charles Kay's children went west, they carried a portrait of their parents with them. This crude likeness was made before the Civil War and is stilt in the possession of Kay descendants in Texas. Charles Kay was a prosperous planter, with a substantial amount of acreage and personal property. A grandchild later commiserated that she had "never washed a dish nor made a bed before the Civil War..." He is listed on the 1840 census of Anderson Co. along with his wife, eight children, and 13 slaves. The 1850 census lists him as age 58, born in VA, his wife Mary as age 53, along with five children and 15 slaves. The 1860 census of Anderson Co. lists him as age 68 living with his grand-daughter Louisa Campbell, age 9, and 15 slaves. The 1860 census lists the value of his real estate as $11,000 and the value of his personal property as $20,000. Mary Johnson, first wife of Charles Kay, died on 17 Apr 1860 and was buried in the Charles Kay private cemetery in Anderson Co. Charles married secondly Charlotte Miller, born ca. 1814, the grand-daughter of the famous printer, John Miller of England who came to Charleston and later moved to Pendleton. He started the Miller's Weekly Messenger in 1795, the first paper in up-country South Carolina. Charles Kay died on 2 Sep 1867 and was buried beside his first wife in his private cemetery near his home. Their tombstone is easily readable today. After his death, his second wife, Charlotte (Miller) Kay, lived with her sister, Jane Miller, in Pendleton, Oconee Co., SC. She is listed on the 1870 census of Oconee Co. as Charlotte Kay, age 56 living in Pendleton and the 1880 census shows her as age 66 living in Pendleton and that her parents were born in England. Charles Kay's will (Roll 2236, pages 280-284, Anderson, SC, dated 23 May 1862, probated 6 Sep 1867) specified his widow Charlotte was to retain property she owned at the time of their marriage, plus 1112 of his estate; the other eleven shares were to be divided equally among his 11 children. A codicil was made on 12 Sep 1866 stating his son, William Marvin Kay, the named executor of his estate was now deceased, and the court appointed a friend John W. Daniel to be the executor. Listed in the 1867 inventory of his property, among other items was an unspecified amount of Confederate currency, now considered worthless. From ;The Descendants of Robert Kay;
