JOHNSON AND OTHERS. Mr. C. J. Mannng and Mr. Hubert Manning for the plaintiffs ; Mr. A. H. Simpson for the defendants Henry and Charles Johnson ; Mr. Hubert Manning for the other defendants. This is a partition suit. The parties are the representatives of tho late Mrs. Charlotte Johnson, who died in September, 1880, and the question involved is whether a power of ap- pointment made by the deceased lady under a deed of settle- ment dated tho 7th July, 1848 to the defendants Henry and Charles Johnson was a defective execution of the power. The defendants Henry and Charles Johnson claim that if the execution be defective, the Court will grant them relief in accordance with the terms of the appointment, on the ground that the other parties to the suit were well provided for in another way, and that they have been in possession of the property in question in equal shares for 18 years and have expended large sums of money in improving it. They claim that in the event of the Court holding the execution to be defective, an account shall be taken of the moneys expended by them in improving the property, and that the amount so found shall be paid to them. Daniel Mathew advertised in the "Sydney Gazette" that he was taking his family to England in the "Surry" Page 4 26th June 1819. He stated that, "he was taking his wife family and a servant Bridget Oliver." Burke's Dictionary of the Landed Gentry Vol.2 M-Z shows that Daniel Mathew died without issue. Bridget by being taken to accompany Mrs.Mathew is shown to be well regarded by Mr and Mrs.Mathew. Was Charlotte part of the "family"? Charlotte married John Johnson, son of Mark Johnson and Frances Mills, on 24 Feb 1833 in Home Of Rev John Dunmore Lang, Sydney NSW AUS. John was born on 1 Oct 1809 in Manchester, Lancashire, ENG, was christened on 10 Oct 1809 in Scotton Parish, Lincolnshire ENG, and died on 22 Mar 1893 in North Sydney, NSW AUS at age 83.
