It should be noted that the below is UNPROVEN. It was researched by a descendant who found a possible match to a possible story about what happened (the parrot story). DNA seems to show that Edward's parents may be different. The headstone was installed much later and the death date is disputed.
UNPROVEN:
A theory is that Edward Upton emigrated Aug. 1763 on the Convict boat "Beverly". The cargo was 121 convicts, he was one of the 36 of the 41 people sentenced to transportation during the July court session on this boat. There are records of an Edward, but unknown if it is out Edward as there are no records that tie together the events of the Edward who was found in London and sent to America and the Edward who is our progenitor.
June 11, 1763, Edward Upton age 28 and Thomas Ryan Indictment London, Middlesex, England. The record found has Edward as a teenager, rather than age 28.
July 6, 1763 London, England, Edward age 28 is convicted of burglary and sentenced to 7 years transportation (white slavery). The captain was "Robert Allan" it took 3 months to sail to Virginia.
Nov. 1763 Rappahanock River, Leeds-Town, Virginia. Virginia Gazette advertisement, November 1763 (Edward Upton is on this boat) "Just arrived in Rappahannock river, the Snow Beverly, Capt Allen from London with a large number of CONVICT SERVANTS; the sale of which will begin at Leeds-Town on Monday the 14th instant, and at Port-Royal the Monday following, and continue there until all are sold.
Dec 17, 1763, Edward Upton is sold 4 weeks after the boat arrives to William Crow, Papers presented in the Augusta Co., Virginia court in 1768.
While there was an Edward who fits the data above, again, it is not proven that he is our Edward.

You may want to make a notation on his memorial regarding the known discrepancy of his death year ... the death date scribed on his marker is incorrect. This date was based solely on old family legend. The marker for Edward was put into place in 1965.
Numerous recorded documents can prove this date as incorrect, i.e. Edward deeds to his sons, Job and Robert, in Jul 1806, 137 acres in Rutherford County. In April 1810 Edward purchases 100 acres from John Hood, witnessed by his son-in-law, Benjamin Brackett. In Jul 1816, he and Benjamin Brackett, go into open court with a prisoner in Rutherford County Court. In April 1817, Edward deeds to his son, Job 150 acres in Burke County, witnessed by Benjamin Brackett. In Feb 1823, Edward purchases a cow from the estate of Benjamin Brackett in Burke County; Edward's daughter, Elizabeth is the administrator of her husband's estate.

b. John: while his existence is recognised in many variations of the family tradition. he is mentioned as coming to America only in the story which makes the boys land in New Orleans; compare him with 4a John Upton of the Fourth American Family.
8 A. Edward Upton, called John by a very few of his decendants but apparently only by inadvertence, appears to have been born near London, England, about 1735, though one form of the tradition says nearly twenty-five years later. All admit that, at the age of thirteen, he ran away from home or from school (and some say, from a widowed mother) on account of having killed a parrot at school. He was accompanied by another boy whom some call his brother John. The boys were pressed on board a Man-Of-War. One tradition says they were not permitted to land for five years; but at last, while anchored near New York City, they swam ashore, concealed themselves; and soon after enlisted in the Continental Army. They were present at the surrender of Lord Cornwallis, and there saw an Uncle of theirs, a wounded prisoner. But this tradition has Edward Upton in the Army at a time when we know he was in North Carolina, begetting children; and probably makes him twenty years younger than he was. A more probable account says the boys landed in New Orleans, where Edward, having been taken with the fever, was left, and saw his brother for the last time. Recovering, he went to sea again and sailed “all over the world,” even to Iceland. Others say his total experience at sea covered eight years.
At last he settled in North Carolina, near the Dan River, we are told; but his first marriage is said to have taken place in Buncombe Co., and some circumstances seem to point to the neighbourhood of Dysortsville or Brackettown, McDowell Co., as the home of his last years. He had two wives, but we have the name of neither. He is said to have married first when about forty years old, and

secondly when quite an old man. The three children of his first marriage removed early to Kentucky, and he visited them there in 1807, accompanied by a small son by his second wife; but he died in North Carolina. His children were,

8AA. Edward Upton of Hardin Co., Ky, born in North Carolina 4 May 1775; married 1st, when hardly more than twenty years of age, Mary Black; (thought it was Rachel?); 2nd, Virginia (or Jane or Genie) Trainer.
When a very young man he removed to Kentucky, and entered land in Green Co. In 1814 he removed to Hardin Co, and bought land at Elk Spring, half a mile from the present site of Uptonville. He resided there till his death, 21 October 1852. His children were,
