Indenture of Sale between Daniell LORD and James LORD

This Indenture of Sale made the Tenth day of July in the first year of the Reigne of our Soveraigne Lady Anne of England Queen: Between Daniell LORD of Say-Brook in the County of New London and in the Colonie of Connecticutt in New England Weaver on the one Part and James LORD of Said place County and Colony Merchant on the other Part Witnesseth that the said Daniell LORD for and in Consideration of a valuable Sume of money in hand Received of an from said James LORD the Receit whereof I doe here acknowledge and of every part and parcell thereof doe acquit and discharge the said James LORD his heirs Executors administrators and assigns for ever Have Bargained Sold given granted alienated Infeoffed and Confirm unto the said James LORD his heirs Executors administrators and assigns a Certain Tract or Parcell of upland and meadow Lying and being at a Certain place beloe the stone pitts in a place Called the Thousand acres in Say-Brook Bounded Southward by the Ox pasture Westward and Northward by Oyster River and Eastward by the Land of Said James LORD Computed by Estimation Seven acres and a halfe be it more or less.

To Have and to Hold all and Singular the aforesaid upland and meadow Woods underwoods, Previlleges Commonages Benefitts Rights members proprieties and appurtenances in any kind whatsoever unto the said James LORD his heirs Executors administrators and assigns to his and their Sole and only use Benefitt and behoofe for ever. And I the said Daniel LORD for me my heirs Executors administrators and assigns doe hereby Covenant Promise and agree to and with the said James LORD his heirs Executors administrators and assigns by these Presents in manner and forme following viz: that I the Said Daniell LORD att and before the Ensealing and delivery hereof am the true and Lawfull Owner of all and Every the afore Bargained premises and have in my Selfe full Right power and Lawfull authority to sell alienate and dispose of the same to him the said James LORD his heirs Executors administrators and assigns for ever and also that the Same is free and Clear from all other or former Bargains alienations Claimes demands and Incumbrances Whatsoever and also that I the said Daniell LORD for me and my heirs Exeuctors and administrators Shall and Will Warrant maintain and defend all the afore Bargained Premises against all Person or Persons whatsoever Lawfully Claiming or demanding the Same: And I the said Daniell LORD doe by these presents Render and give unto the said James LORD full Possession ?? and delivery of all the afore Bargained premises.

In Wittness whereof I have hereunto Sett my hand and Seal the day and year above Written: Anno Domi one thousand Seven hundred and Two
