Gardner, 78-year-old retired well-known Creek road farmer, a former member of the reportorial staff of The News and twice a candidate for Geneses County Assemblyman, died at 8 o'clock last evening (July 19, 1943) at the Batavia Hospital where he had been a patient for ten days. He underwent an operation on Friday for a stomach ailment after being in failing health for several months. Owner of the Locust Level Farm on the Creek road, Mr. Gardner was active in farm organizations and he was a member of Stafford Grange for nearly half a century. He served as justice of the peace of the town of Alexander for 24 years, beginning in 1899 and was a candidate for assemblyman in 1916 and 1928. A life-long resident of Genesee County, Mr. Gardner was born at Elba on June 13, 1865, a son of the late John C. and Maria Judd Gardner. On November 11, 1875, he moved with his parents to the Locust Level Farm. He was graduated from the Batavia High School in 1888. He taught school the winter before entering high school and the winter following his graduation. In May, 1889, Mr. Gardner began reading law in the office of the late Frank S. Wood, who was then district attorney. Giving up aspirations for a legal career, he became a reporter for The News in June 1890, continuing in that position until December, 1891. He did various kinds of work until March 1897, when he went back to work the Creek road farm for his mother, his father having died in 1893. Mr. Gardner married Miss Alice H Day, Batavia attorney, on January 8, 1907, at the Day homestead at No. 20 Summit Street. They had six children, two of the five sons now serving in the armed forces. A self-styled "dirt farmer," Mr. Gardner often publicly expressed his views on political issues and when he announced his candidacy for the Republican nomination for member of Assembly in 1931 hw said he was interested in the "right of all classes, having in mind always the welfare of the nation as a whole." He took great pride in his apple orchards and flower gardens and invited motorists to drive out the Creek road and see his flowers, which were planted sevearl hundred feet along the road in front of his farm. Joining Stafford Grange in 1897, Mr. Gardner took part in many of the programs and held a number of grange offices, including serving as master for two years. He was a past grand and honorary member of Batavia Lodge No. 197, IOOF, and a past worthy patron of Batavia Chapter OES. Mr. Gardner was a member of Masonic bodies of Batavia for more than fifty years, his affiliations including Batavia Lodge No. 475, F&AM, VAtavia Chapter; No. 35, RAM; and Batavia Commandery, No. 34, Knight Templar. He became a member of the First Presbyterian Church of Batavia when he entered high school and served on the board of ushers for four years; the board of deacons for 11 years and later as principal of adult education. Besides his wife, Mr. Gardner is survived by their five sons, Harris Day Gardner of Byron, John C. of Bethany, F.
