He held the office of Gentleman of the Bedchamber to King James VI of Scotland in 1596. In February 1597/98 he was granted the former Carthusian priory at Perth with a Lordship, but he had insufficient wealth for the upkeep, and had the grant annulled. He was invested as a Knight before 1609. He held the office of Gentleman of the Privy Chamber in 1612. He held the office of a Lord of Session in 1616. He held the office of Lord Clerk Register between 1616 and 1622. He was invested as a Privy Counsellor (P.C.) [Scotland] in 1622. He held the office of Lord Chancellor [Scotland] between 1622 and 1634. He was created 1st Viscount of Dupplin [Scotland] on 4 May 1627. He was created 1st Lord Hay of Kinfauns [Scotland] on 4 May 1627. He was created 1st Earl of Kinnoull [Scotland] on 25 May 1633, with a special remainder to heirs male whatsoever.
