Taken by Andrew Robe, Jonathan Pettebone and Amos Wilcocks. Will dated 21st December, 1749. I, Joseph Phelps of Simsbury, in the County of Hartford, do make this my last will and testament: After my funeral charges and just debts are paid, for the love I bear to my well-beloved wife Mary, I do give unto her my brass kettle, my great Bible, and my featherbed with the furniture thereunto belonging, viz., two pare of sheets, and with it my bed called Tom's bed, with the furniture belonging to it, to be her own forever; and also I do give unto her the use and service of my negro man Tom during her life. Also I do give unto my sd. wife 1-3 part of all my remaining personal estate, to be her own forever. Also I give unto her the use of all my buildings and improved lands during life. I give unto my son Joseph œ10, to be paid unto him out of my moveable estate equal to old tenor bills, over and above what I have already given him by deed. I do give to my son Amos my lands lying in Farmingtown, viz., land that I bought of my son Joseph, and the lands that I bought of Daniel Andruss, and the land that I bought of Joseph Woodford; and also my division land lying in Simsbury, about 7 acres. I do give unto my son David 10 acres of land on the north side of my meadow lott, in breadth 20 rods and in length from the river eastward 80 rods, bounded north on land of Capt. James Cornish, west on the river, south and east upon land that I have given to my son Amos; and also all my land lying on the hill east of Weatogue House, and all my land lying on the North Mountain north of the siding way as it is called, both pieces bounding south on the road that leads to Hartford; and also my land on the hill which I bought of Samuel Pettebone the 2nd; and also my homelott with my buildings on it, and all my upland and marsh and meadowland adjoining to my sd. homelott, lying partly in Long Meadow as it is called, to be to him and his heirs forever. Also I give unto him my negro man Tom after the decease of my wife. Also, I do give unto my grandson Samuel Humphrey, son of my daughter Hannah decd., œ10 in old tenor bills, out of my personal estate. Also, I do give him about 5 acres of land lately laid out to me at the north end of Whortlebury Hill as it is called, to be to him, his heirs and assigns forever. All the rest of my personal estate I give to my two daughters, viz., to Damarus and Elizabeth, to be equally divided between them. I appoint my wife Mary and my son Amos and my son David executors. Mary Orton was not the mother of Samuel first son of Samuel Humphrey. See "Humphreys Family in America" 1885. Ancestry.com book pages 252/3: Samuel ll was son of first wife Hannah Phelps who died after childbirth in 1710.
