Inquisition on body of Nicholas Grout (Trout), 17th July, 1753. Jurors do say that the said Nicholas Trout, in simplicity, without malice, playing with Peter Hull and seizing a gun in said Hull's hands and pulling its muzzle towards him she accidentally went off without any act or knowledge of the said Hull and discharged herself with a ball and two great shots into ye breast of said Trout, of which he died immediately on ye spot, and quit ye gun wherewith ye same was done was entirely in fault for not keeping her bounds, but going off without force or consent. Jacob Trout and Barbara ( ) to George Shaver, 65, 145 acres, part of Jacob Stover's great tract formerly conveyed to Christopher Francisco, Sr., then to Nicholas Trout, 2d July, 1752, and inherited by Jacob as heir-at-law of Nicholas, on Shanando River, beginning on side of Cub Run; corner Ludwick Francisco; corner Morris Pond. Teste: John Peter Tresler, Nicholas ( ) Millbery, Volintine ( ) Trout Delivered: Geo. Shaver, 2d June,

1770.

On 5 Sep 1738, Hans Nicholas TRAUT, age 11, arrived in Philadelphia with his siblings and recently widowed father, having sailed on the Winter Galley (Hope Shipping Company), commanded by Edward Painter. By 1739, Hans Nicholas, father Johann Wendel Georg TRAUT and family were living in (current) Paradise Twp, near Strasburg, Lancaster, PA.

In about 1748, Hans Nicholas TRAUT, age about 20, married unknown, in Strasburg, Lancaster, PA. At least (4) children were born to this union, Jacob C., circa 1749; (Ensign) Georg Michael, circa 1750; Valentin, Oct 1752; and Henry TRAUT, circa 1753, the first two issue being born in Bart Twp, Lancaster, PA and the last two sons being born on Cub Run near the base of Peaked Mountain, Augusta (now Rockingham), VA.

On 13 Oct 1748, Hans Nicholas TRAUT, age 21, applied for a land warrant on 137.5 acres in Bart Twp, Lancaster, PA, just south of Mine Hill, and two miles nearly due south of his parents' original family farm "Whiskey Spring" in Paradise Twp, Lancaster, PA.

Four years later, in 1752, Hans Nicholas TRAUT and his young family, together with older brother Hans Georg TRAUT (28) and perhaps younger brother Johann Deobalt TRAUT (17), moved from Bart Twp, Lancaster, PA, some 200 miles southwest to Cub Run, Augusta (now Rockingham) County, VA where Hans Nicholas purchased 145 acres near the base of Peaked Mountain. Younger brother Hans Michael (22) stayed behind and worked the Bart Twp family farm.

On 17 Jul 1753, Hans Nicholas TRAUT (age 25) was accidentally shot and killed when rough-housing with a close friend and neighbor Peter HULL. The following Augusta County Court record documents the tragic accident:

"Inquisition on body of Nicholas Trout 17 July 1753. 15 Aug 1753 - "Peter Hoult tried and acquitted of murdering Nicholas TROUT who was killed by accident in a scuffle."

22 Nov 1753 - [Hans] George TROUT, brother of Nicholas TROUT qualifies on latter's estate, the widow [not named] refusing. Older brother George TROUT, neighbor Valentine PENCE, and George's father-in-law Christian CLEMONS giving their bond.

6 Dec 1753 - (brother) Hans Georg TROUT is named administrator for settlement of the above estate, it being recorded on 21 May 1766. Cash paid for liquor at the vendue, 5 gallons at 3/; cash paid for liquor at a grubbing frolick, 6 quarts at 9 per quart 0.5.6 pounds; cash paid for 6 quarts of liquor at the funeral, 0.4.6 pounds.

c 1754 - Eldest son Jacob, age 5 and not of age, inherits his father Nicholas' land between Cub Run and Peaked Mountain).

21 May 1766 - Augusta Courts determine that Nicholas' orphaned minor children Michael, Valentine, and Henry should be "bound out."

19 Nov 1767 - Henry TROUT, orphaned son of Nicholas, bound out to Conrad FUTCH.

15 Mar 1770 - Hans Nicholas' oldest son and heir, Jacob TRAUT and wife Barbara PRICE, transfer 145 acres of land to George SHAVER. This is the same tract on Cub Run that Jacob STOVER had originally transferred to Christopher FRANCISCO, Sr. who had in turn transferred it to Hans Nicholas TRAUT on 2 July 1752, then being eventually inherited by Jacob as the heir-at-law of Hans Nicholas. Jacob's younger brother, Valintin(e) TROUT, was among the testators to this deed.
