A charge of improper passing has been filed by the Iowa highway patrol against Henry Killian of Oakland, driver of the car which figured in the accident in which Harry Cary of Griswold was killed on U.S. 6 west of Lewis May 26, 1948. The patrol charges the car and truck did collide as the car allegedly passed the truck and then overturned on the paving as it struck a flume. The truck also struck the flume and overturned after leaving the highway. Mr. Cary was thrown from the truck.
