James BANKS and wife Clara, residing at Collet's Farm near Bathurst in the district of Albany, Cape of Good Hope, married in community of property, on 10 APR 1846.
James gives to his wife Clara all his real estate during her natural life and immediately after her decease or second marriage I give my estate to my two daughters Mary Ann and Sarah Ann and to all other children of us born hereafter, in equal shares, and to their heirs. I give my personal estate and effects to my wife Clara for her use as before and upon her death or second marriage to all my children in equal shares.
Ditto for Clara.
We appoint each other as Executors of our estate together with Samuel HAYES, Blacksmith of Bathurst.

CODICIL
We, residing on one of the locations alloted to James's Party of Settlers near Bathurst, have made a Will on 10 APR 1846 make this codicil and where we devised all our real estate to each other, the survivor of us, hereby revoke the said devise to our daughters Mary Ann and Sarah Ann, and upon the death of the later survivor, give to our two sons James Henry and Jeremiah and to other sons if any all our real estate in equal shares, and to our daughters Mary Ann, Sarah Ann and Louisa and our daughters if any who shall hereafter be born, and their heirs a sum of money payable from our said estate if it were appraised at our decease or second marriage to be of the same value as was given to the former proprieters ie. James RANDALL deceased and James JONES, Esquire or the same value of the parts of it left in our estate.

1. Divisional Council valuation of the landed property brought up in the account should be furnished.
2. The Executors commission on the asset brought up in the account should be computed at 1 1/2 % only.
3. Vouchers should be furnished in support of the items brought against the estate.
4. The account is long overdue. Unless the Executors furnishes me with the approval of the heirs in writing to the account as framed the commission will have to be expunged.
5. When and where did James Henry BANKS die and who is the Executor of his estate.

1. The Farm Jones Party bought for £500 and allotment James Party No. 3 & C is Valued at £200.
2. A/c amended and commission charged at 1 1/2%.
3. All vouchers furnished except acquittances from heirs which I cannot obtain unless property is sold.
4. Heirs will not approve of a/c, can I sell the property? Jeremiah BANKS is ... and will pay his share into the estate but ... L. B. BOLD? ... of James Henry BANKS, will not pay but offers security if I ....share of property to him.
5. In Kapiland near King Williams Town in 4 FEB 1877 (in pencil just above the date is another date of 5-1-77). Mr. L. B. BOLD? Attorney of Grahamstown is Executor.
