Jefferson County records on the CD: 1824 February 2. Will of James Hendricks, WB 5, pp. 402-403, Jefferson County, WV. In the name of God Amen. I James Hendricks of the County of Jefferson State of Virginia, considering the uncertainty of this life and being of sound mind and memory blessed to the Almighty God for the same do make and publish this my last will and testament In manner and form following, that is to say Item 1st. I give and bequeath unto my beloved wife Jane Hendricks the one third of my lands during her natural life. I also give and bequeath unto her my two negro girls Mary and Catherine to her and to whomsoever she my said wife may think well to will them at her decease. I farther give and bequeath unto my wife one bay mare called Pet, my carriage, two cows, six hogs, and six sheep all of which such as she may make choice of out of my stock, all my bedding, bed furniture with their bedstands, my seccatory, one pair of looking glasses, six windsor & six split bottom chairs such as she may make choice of, all t cupboard furniture of whatever description it may be of, one churn, two tubs, two buckets such as she may make choice of, two fat tubs with whatever lard their may be in them, one large copper kettle, one small iron kettle, one iron pot, one Dutch oven such as she may make choice of, one tea kettle, one pair of smoothing irons, one large wool spinning wheel, one flax spinning wheel, and one reel of all such as she may make choice of, also one piece of linsey supposed six yards, all of which articles to her and to whomsoever she may think well to leave them at her decease. It is also my will that my wife shall have a sufficient quantity of wheat, rye, corn, and bacon to support her and her family and stock until it can be raised for her from the rents of the third of my lands. It is farther my will that my wife shall have and occupy the west end of my house that is one room on the first floor and one room above stai the second floor also equal rite and priviledges in common with my son James Hendricks in the Kitchen, Sellar, Milk House, and Smoke House. Item 2nd. I give and bequeath unto my son John Hendricks one negro boy named Tom now in his possession which negro boy and what I have already given makes his portion of my property. Item 3rd. I give and bequeath unto my son James Hendricks the part of my land I now live on namely that part joining lines with James Glenn on the north and west and Duffell on the east and by a dividing line which I have marked and laid down by a survey made by D. Buckles. Beginning at a stone corner to Jas. Glenn at the west side of my track thence to a rock on the east edge of the fruite Ridge Road thence along said road to a stone set in the ground on ther east side of said road and near Nathan Hendricks well, thence crossing the entire track to a stone placed in the ground in the line of Duffell to him, his heirs and assigns forever after paying to my grand daughter Mary Osborn one hundr and fifty dollars. I also give and bequeath unto my son James Hendricks one negro boy named Tom now in his possession to him his heirs forever also his part of the grain of whatever it may be in the barn, house, stock, or other whereas also his part of the grain in the ground for heretofore he has rented ther land from me and by verble bargains gives me one third of all raised on said land. Item 4th. I give and bequeath unto my son Nathan Hendricks that part of my land which he now lives on including the lot of land I got of Daniel Hendricks and joining lines with Jas. Glenn and Mrs. Hunter on the north and west and Mrss Hunter and John Snider on the south and Richard Duffel on the east thence with the dividing line marked out in item 3rd to James Glenn stone corner to him, his heirs and assigns forever after paying to my daughter Elizabeth Mallroy fifty dollars, which fifty dollars he is not to pay until four years after my decease with interest from the time of my decease until paid, also fifty dollars to my daughter Susan Catlet which fifty dollars he shall pay three years after my decease with interest from the time of my decease until paid, also fifty dollars to my grand daughter Mary Osborn when she arrives at the age of twenty one years but without interest. I give amnd bequeath unto my son Nathan Hendricks one negro boy named Saul now in his possession to him his heirs and assigns forever. It is my will that he shall have his part of the grain of whatsoever ki it may be either in the barn, house, stack, or otherwheres, also all his share of the grain in the ground on the land which he now farms for he has also by verbal bargain rented said land and has agreed by said bargain to pay me one third part of all that may be raised on said land. Item 5th. I give and bequeath unto my daughter Elizabeth Maleroy one negro boy named Ben also fifty dollars to be paid her by my son Nathan Hendricks as above stated also one half of the amount of my personal property not heretofore devised, after paying all my just debts, funeral expenses, &c, which bo fifty dollars., and said half amount of sales of personal property whatever it may be shall be kept in the hands of my executors, he negro boy to be hired out yearly and so much of the said hire and money paid to my daughter Elizabeth Maleroy as my executors may think her necessitites may yearly require. At the death of my daughter Elizabeth Maleroy it is my will that said boy Ben if living shall be sold by my executors and the price of said boy with the ballance of said money should their be any on their hands shall be equally divided between my grandchildren Caroline, Elizabeth, and Jane Maleroy. Item 6th. I give and bequeath unto my daughter Susan Catlett one negro boy named Cesar also fifty dollars to be paid her by my son Nathan Hendricks as before mentioned. Also the one half of my personal property not before devised and after paying all my just debts, funeral expenses, to be paid to her by my executors. Should she die before said negro boy Cesar it is my will that the said boy shall be sold and the money equally divided between my grandchildren Letty Ann and Mariah Jane Catlett to them their heirs &c. Item 7th. I give and bequeath unto my grand daughter Mary Osborn one negro girl named Hannah, also one hundred and fifty dollars to be paid her by my son Nathan Hendricks when she arrives at the age of twenty one years. It is my will the above sum of money shall not bear interest until she arrives at the age of twenty one years. Should said grand child Mary Osborn die before she arrives at the age of twenty one years leaving no lawful issue It is my will that said negro girl and money shall be given by my executors to my grandson James Osborn.

Item. 8th. It is my will that all my just debts and funeral expenses &c. shall be paid out of my personal property after taking therefrom such articles as devised to my wife Jane Hendricks. Item 9th. It is my will that my wife Jane Hendricks shalll have ther third part of the grain on hand also the oner third of the grain in the ground of whatsoever kind it may be at my decease. I do also appoint my sons James and Nathan Hendricks executors of my la will and testament hereby revoking all former testaments by me made ....

1828 June 16. Will of James Hendricks, WB5:402-403, Jefferson County. Wife's name is Jane; she retains 1/3rd of land while alive and gets two negro girls. 1836 November 21. Will of Jane Hendricks, WB9:3-4, Jefferson County. Son is Daniel Hendricks. Blacks Phebe and child Sarah to be freed; daughters Nancy McCormick, Briscilla Kizan, Milly Hewett (deceased), and Elizabeth Long.

Mr. Wood is a very nice person to deal with, I sent for a will of one of my ancestors I sent a check for ten dollars to cover expenses, He sent the will and a five dollar refund. Since Jefferson County didn't become a county until 1801(before it was considered Berkeley County), this is why James Sr. will is in Berkeley County and James Jr. is in Jefferson County.
