James Tooke, son of James Tooke and Dorothy Gray of Hertfordshire, and James Tooke of Virginia, are not the same person. Previous research had not identified that James the son of James Tooke and Dorothy Gray was born in about 1620 and was buried 24 March 1637/38 in Stepney, Middlesex, England. There are numerous publications that incorrectly identify their son James as being the immigrant to Jamestown, Virginia.

The origins of James Tooke are presently unknown. James Tooke came to Virginia on the George and landed at Jamestowne in Oct 1621 with Sir Francis Wyatt and his party, his passage being paid by William Spencer. William Spencer's land patent for the transport of James Tooke was granted in 1637.[1][2] He settled first at James City, where he was living 12 Jan 1626/7 when he received permission to "remove from the Maine without James City and plant at Mulberry Island." There is no record of his owning land at Mulberry Island.[3].

He was listed in the Muster of 1624/5 as a servant of the Governor living at the Maine in James City and was unmarried.

He served as Clerk of the Court of Isle of Wight County, Virginia; as a member of the House of Burgesses 1639-40 from Isle of Wight.[4] James Tooke also served as Isle of Wight County Court Clerk, Burgess or County Officer in 1646.[5]

Death

He passed away before February 2, 1662 when his 1659 will was probated.[8]

James Tooke came over on the George and landed at Jamestowne in October 1621 with Sir Francis Wyatt and his party. A grant to William Spencer of James City, later Surry, furnishes proof of James Tooke's coming in the George, for Spencer obtained a grant of 250 acres in 1632, 50 acres of which were on the west side of Lawne Creek, due "in right of James Tooke who came in the George in 1621, the charges of whose passage he defrayed unto William Dunn, carpenter of said ship and 50 acres in right of Joseph Deane who came in the Abigail in 1622 whose passage the said Spencer defrayed unto John Tooke, Mariner". (Seventeenth Century Isle of Wight County, Virginia, Boddie, page 260).

W.; 50 acres accrewing due in the right of JAMES TOOKE whoe came in the George 1621, right of passage hee defrayed unto William Dunn, Carpenter of the said shipp, 100 acres in the right of Hugh Wynn, and Robert Latchett whoe both came in the George 1621 at the charges of Captain William Pierce whoe in open Court hath transferred the land accrewing by vertue of their passage unto the said William Spencer; 50 acres in right of James Robinson, whoe came in the Charitie whose passage said Spencer defrayed unto Mr. Weston, Merchant of the said ship, and 50 acres in right of Joseph Deane whoe came in the Abigail 1622, whose passage said Spencer defrayed unto John Tooke, Mariner. In 1630, James Tooke was bequeathed L50 by Christopher Tooke his uncle in England. See the will of Christopher Tooke dated 1630 in the previous section.

December 1634, William Lacey leased James Tooke 500 acres on the east side of Lawne's Creek. William Lacey mariner of Yarmouth in Isle of Wight County for the heirs of Captain Robert Gyar to James Tooke of Warwicksguyoake on the east side of Lawnes Creek (being a neck of land). Witness: John Butler and John Smith (Isle of Wight Deeds, Wills, Guardian Accounts, Book A, page 15, 1636-1767 by Hopkins).

25 July 1642, Thomas Gyer allows the above lease (Isle of Wight Deeds, Wills, Guardian Accounts, Book A, page 16, 1636-1767 by Hopkins).

26 October 1646, James Tooke to Robert Harris, all my right and title to this lease (Isle of Wight Deeds, Wills, Guardian Accounts, Book A, page 17, 1636-1767 by Hopkins). Therefore by 1634, James Tooke was living on the east side of Lawne' Creek, in Isle of Wight County, Virginia.

It appears that James Tooke went back to England prior to 1637 and returned to Virginia in 1637. Early Virginia Immigrants 1623-1666 by George Cabell Greer, page 331, " James Tooke 1637 paid by William Spencer". William Spencer and James Tooke clearly had a relationship as William Spencer had obtained 50 acres in 1632 on the right of passage of James Tooke in 1621.

It may have been that James Tooke returned to England to obtain his inheritance because by 11 November 1640 he had acquired 900 acres in Isle of Wight County, Virginia. By 03 January 1661, his younger child William possessed this 900 acres.

On 14 September 1653 James Tooke patented 178 acres in Isle of Wight upon the head of one of the Black Water branches, near Thomas Pritehart's cartway. This tract was repatented 09 March 1662/3 by Thomas Tooke as due said Thomas and heire of James Tooke." (Adventurers of Purse and Person, 1987, page 623)

James Tooke was a member of the Virginia House of Burgesses 1639/40, and in 1646, and was a Justice of the Isle of Wight County from 1646-1649.

Executor: Son Thomas D. 01 February 1659 R. 02 February 1662 Witnesses: Thomas Carter Thomas Gwaltney John Harvey was Governor of North Carolina in 1679. 11 September 1664 Nansemond County, Virginia; (Boddie, Isle of Wight County, Virginia, page 262).

The lineage of James Tooke of Virginia is further described in a book entitled: "The Carters of Virginia", by Noel Currer-Briggs, the renown English genealogist, published 1979 by Phillimore, Sussex, England. See pages 25-26, and 96. On page 26, Noel Currer-Briggs states, "The James Tooke who went to Virginia was one of the nine sons of James of the Court of Wards." (Although no baptismal record has been located for James Tooke, Noel Currer-Briggs is clear that James Tooke was " one of the nine sons of James of the Court of Wards".

The full will of James Tooke of Virginia is as follows: In the name of God Amen, I James Tooke of the Isle of Wight County, in Virginia, thanks be to God being in perfect memory do make this my Last Will and Testament in manner and form as followeth. First, I do bequeath my soul into the hands of Almighty God trusting to be saved by the merits of Jesus Christ my Saviour, Redeemer and my Body I do bequeath to the Earth and for that Worldy Goods and Estate that God hath blessed me withal I do bequeath in manner and form following. I give unto my son Thomas Took that tract of land which I now do inhabit and dwell upon- the tract of land is 800 acres as appeareth by the Patent of the said land and I do give this land to my son Thomas with all the Houses or Housing that is upon the same to him and to his heirs forever with all Appurtenances belonging to the same. I give unto my Daughter Dorothy the Wife of John Harvey a Feather Bed and Bolster, A Rugg and Blanket and a Pair of Sheets which is now at Southward in the custody of the aforesaid Harvey, my son in law, another pair of Sheets I also bequeath to my daughter and half a dozen of Napkins and a Table Cloth, a Beer Bowl of Plate. A small silver Draw Cup and a silver Spoon, a copper kettle, a pewter candlestick and a pewter Chamber pot. (The origin of the (Toke) Tooke Family is said to be from Le Sire de Toke who was with William the Conqueror (1027-1087) at the Battle of Hastings (1066). His descendant Robert de Toke who is the first mentioned in the lineage of this family was with Henry III, King of England (1207-1272) in 1264 at the Battle of Northampton and from him were descended the Tokes of Bere in Westcliffe and Goddington. His great grandson was called Toke, de Toke of Westcliffe, from whom descended in the fifth generation John Toke of Bere who married Joyce daughter of Sir Thomas Hoo).

32)James Tooke was born about 1600 in Hertfordshire, England and died 02 February 1662/3 in the Isle of Wight County, Virginia. He came to Virginia 1621 on the George. His wife is not known. On 12 January 1626, James Tooke was granted permission to remove from the "Maine without James City and to plant at Mulberry Island", just south of James City (Jamestowne) on the east side of the James River. In 1635, James Tooke was living at Pashbyhaes in James City County. By November 1640 he had patented 900 acres of land in Isle of Wight County, Virginia. He was a member of the House of Burgess 1639/40 and again in 1646. He was a Commissioner, Justice and Clerk of Court for Isle of Wight County. His will was written 1659 and was proved 1662 in Isle of Wight County. He is a qualifying ancestor for the Jamestowne Society. He had several children: three documented-Thomas Tooke, and Dorothy Tooke who married John Harvey, Governor of North Carolina in 1680; and William Tooke mentioned in the will of James Tooke.

(While some authors have questioned the ancestors of James Tooke of Virginia, the renown English genealogist and author Noel Currer-Briggs has researched the Carter family and the Tooke family of Hertfordshire, and has stated without question James Tooke of Virginia was one of the nine sons of James Tooke of Hertford, Auditor of the Courts of Wards and Liveries. The Carters of Virginia page 26.)

(In Colonial Americans of Royal and Noble Descent, Alleged, Proven, and Disproven, by Patricia Ann Scherzinger, Heritage Books, 1996, Bowie, Maryland, Scherzinger finds "proof of alleged royal ancestry of James Tooke lacking". It appears she was not familar with and did not did not take the time to review the premier work stated above by Noel Currer-Briggs.)

Not only did Noel Currer-Briggs spend several years researching the records of the Tooke family of Hertfordshire, but in 2001, I also employed English genealogists to further research the Tooke records of all of England. The BEST evidence I have supports completely the work of Noel Currer-Briggs, and that of Robbie Lee Gillis Ross, who also employed English genealogists for several years (stated above).

In fact there were several wills of uncle's of James Tooke of Virginia who referred to him. See the will of Christopher Tooke, Uncle of James Tooke of Virginia. Christopher Tooke refers in his will to his nephew James Tooke.

THEREFORE TO DENY THE JAMES TOOKE OF VIRGINIA ANCESTRY, ONE WOULD HAVE TO DISPROVE THE "TOUR DE FORCE" WORK, "THE CARTERS OF VIRGINIA", BY NOEL CURRER-BRIGGS.

James Tooke was a member of the Virginia House of Burgesses 1639/40, and in 1646, and was a Justice of the Isle of Wight County from 1646-1649.

   In the name of God Amen, I James Tooke of the Isle of Wight County, in Virginia, thanks be to God being in perfect memory do make this my Last Will and Testament in manner and form as followeth.
   First, I do bequeath my soul into the hands of Almighty God trusting to be saved by the merits of Jesus Christ my Saviour, Redeemer and my Body I do bequeath to the Earth and for that Worldy Goods and Estate that God hath blessed me withal I do bequeath in manner and form following.
   I give unto my son Thomas Took that tract of land which I now do inhabit and dwell upon- the tract of land is 800 acres as appeareth by the Patent of the said land and I do give this land to my son Thomas with all the Houses or Housing that is upon the same to him and to his heirs forever with all Appurtenances belonging to the same.
   I give unto my Daughter Dorothy the Wife of John Harvey a Feather Bed and Bolster, A Rugg and Blanket and a Pair of Sheets which is now at Southward in the custody of the aforesaid Harvey, my son in law, another pair of Sheets I also bequeath to my daughter and half a dozen of Napkins and a Table Cloth, a Beer Bowl of Plate. A small silver Draw Cup and a silver Spoon, a copper kettle, a pewter candlestick and a pewter Chamber pot. A smooth Iron and a small Feather Bed with a Canvas Ticking, two small Rings, one with a stone and the other without. I give likewise to my daughter four cows and a Heifer that is already in the custody of her husband John Harvey at the Southward.
   I Give unto my son William one cow, called Troublesome and I give to my son Thomas my Signett Ring and my debts being paid I do give all the rest of my Estate and venture that I sent to sea or the produce of the same to my son Thomas after my decease.
   And I do in this my Will give another tract of land called by the name of the White Marshes to my son Thomas Took and his heirs forever. This land being mentioned for place and Quantity in a separate Patent by itself.
   Lastly I make, Constitute and Ordain, my son Thomas Took my full and whole Executor of this my Will and Testament.
   In Witness, I have subscribed the same this First Day of february Anno 1659.

       James Tooke, the imigrant ancestor, second son of Jarnes Tooke and his
       wife, Dorothy Gray, Ca me to Virginia on the ship George in 1621 or 1637
       (the records differ). He was a prominent Qu aker. In a will proven in
       I662, Isle of Wight Co., Virginia, James Tooke left land and a sign et
       ring to son Thomas. He also named son William and daughter Dorothy who
       married John Harvey , Governor of North Carolina 1678-79. James Tooke was
       a Burgess for Isle of Wight County. Th e name of his wife is unknown to
       me.
       The following inforrnation is from "Genealogical History of the Tooke and
       Related Families" c ompiled by Mary Tooke Rockwell and Ida Gertrude Tooke:
       "There are those who discredit the supposition of Boddie (17th century
       -97 ap. 260-6880) tha t James of Virginia was the son of James Tooke and
       Dorothy Gray of Herts, England.
       "However, it seems to me that the record as we have found it, does
       support the theory that h e was the son of James Tooke of St. Albans,
       Hereford, England.
       "Of course, we have no positive documentary evidence, but this James did
       have a Son named Jam es, one of twenty chiidren.
       "The reason for doubt given was, thc name James was not carved on his
       father's tomb, and is n ot mentioned in his father's will in 1655,
       written seven years before James of Virginia's dea th. However, only
       seven of James of St. Albans children were mentioned in his wlll and they
       s eem to be the younger children, except Edward, who was executor of the
       will.
       There is no record of the death or burial of the youngest James Tooke of
       Herts in the Churc h of Essenden, where his parents are buried, or
       elsewhere."A John Tooke, a mariner of Herts , made a voyage to Virginia
       on the 'Abigail', arriving there in 1622 and received payment fo r the
       passage of a Joseph Deane from William Spencer of Virginia, who had also

       1664, had been assigned to Cobb on Januar y 3, 1661, by WILLIAM TUKE,
       'son and heire' of JAMES TOOKE, the original patentee.
       "On September 14, 1653, JAMES TOOKE patented I78 acres in theIsle of
       Wight County, Virginia , upon 'the head of one of the blackwater branches
       near Thomas Prichard's cartway'. This trac t was repatented March 9,
       1662, by THOMAS TOOKE 'as due sd Thomas as son and heire to James T ooke'.
       "A grant to William Spencer of James City, later Surrey County, furnishes
       proof of JAMES TOOK E's coming in the 'George', for Spencer obtained a
       grant of 250 acres in 1632, of which 50 ac res were on the north side of
       Lawn's Creek, 'due in the right of Joseph Deane, who came in th e
       'Abigail' in 1622, whose passage the said Spencer defrayed unto John
       Tooke, manner.'

       16, 1623. the above "Hotton's" is an original list of "Person s of

   James Tooke, born ca. 1601 Hertfordshire, England. died before02 February 1662/3 in Virginia. He arrived in Virginia 1621 on the George and his expenses were defrayed by William Spencer upon the ships carpenter. In 1630 his uncle Christopher Tooke of London in his will left him L50. In 1634 he leased 500 acres on the east side of Lawnes Creek. By 11 November 1640 he had acquired 900 acres in Isle of Wight County, Virginia on the head of one of the branches of the Blackwater near Thomas Pritehart’s cartway. He was a member of the Virginia House of Burgess 1639/40, and in 1646. In 1646-1649, he was Justice of Isle of Wight County. His wife is unknown. He had three known children:

James Tooke, was possibly one of the twenty children of James Tooke and Dorothy Grayof StAlbans and Herlford, Heftfordshire, England. He arrived in Virginia in October 1621 atthesanre tinre as Sir Francis Wyatt aboard the George, his passage paid by William Spencer who in1632 patented land using among others Tooke's headright of 50 acres.
