In the name of God amen I Jeremiah Pate of Botetourt County and State of V irginia being sick and weak of Body but of Perfect mind and memory remembe ring, that it is appointed for all men once to die I recommend my soul to god who gave it & my body to be uried in a decent manner without Po mp or Vanity as for my worldy Estate with which it hath Pleased God to bless me I give and bequeth in the manner following my will and desire is th at all my Just debts and funeral expenses be Paid out of my Estate by my Executors here of tis named. Item I give and bequeth to my daughter Rhoda Pate one horse valued at fifteen pounds Current money and a new saddle a nd Bridle and a good feather Bed and Furniture one cow and calf Item I gi ve and bequeth to my daughter Amelia Pate on fifteen Pound Horse with o ne Saddle & Bridle as the two others also one feather Bed and one Cow and Calf Item I give and bequeth to my Son Minor Pate one horse Saddle a nd Bridle the horse equal in value with the other two that is to say at fi fteen Pounds also one feather bed & a Cow and Calf Item I give and beque th to my daughter Polly Cumpton one horse valued at fifteen pounds wi th a Saddle and Bridle also one feather Bed and one Cow and Calf Item I give and bequeth unto my son Mathew Pate one horse valued at fifteen Pounds with a Saddle and bridle also one feather Bed & one Cow and Calf Item I give and bequeth to my son William Pate the Colt the Old Grau Ma re is now with if it Lives two Months if it dies before it is two Months o ld to have a horse at fifteen Pounds value also a feather bed and one Cow and Calf Item I give and bequeth to my son Jeremiah Pate one feather b ed and one Cow and Calf Item I give and bequeth to my Daughter Judith Pa te one Grey Horse Saddle & Bridle one Cow and one feather bed which She h as already received Item I give and bequeth to my son John Pate one Horse Saddle and bridle one feather bed and one Cow and Calf which he has alr eady received Item I give and beqeth to my son Edward Pate one horse Sadd le and bridle one feather bed and one Cow and Calf which he has already Re ceived Item my will and decree is that the Land whereon I now Live be Equa lly divided between my four sons Viz Jeremiah William Mathew and Miner Likewise my will and devise is that all the rest of my estate consisting of Household Furniture Stock of every kind and Negroes be equally divided betw een My ten Children Vis Edward, John, Judith, Jeremiah, William, Mathew, Polly, Minor, Amelia and Rhoda when my daughter Rhoda Shall arive to the a ge of fourteen Years Likewise my will and desire is that my four Sons Jere miah William Mathew and Miner Shall have the care and Management of a ll my estate of Lands Negroes and Stock and to have the benefits and advan tages arising threfrom amongst them Provided they Furnish to miners Amel ia and Rhoda with a reasonable maintainence and Schooling clear of expens es untill Rhoda arrives to the age of fourteen years and I do hereby nomin ate and appoint my well beloved Brother Matthew Pate and his son John Pa te Executors of this my last will and Testament and I do hereby disowed a nd make void all wills and Testaments heretofore by me made and do ratify and confirm this to be my last will and Testament In witness where of I do herunto Set my hand and Seal This Fourth day of April A.D. one Tho usand Seven hundred and Ninety Seven Jeremiah Pate Seal

This last will and Testament of Jeremiah Pate Decd was exhibited in Cou rt and proved by the oaths of Dabney Shrewsbury and John Woods two of t he witnesses thereto Subscribed and thereupon ordered to be Recorded a nd on motion of Matthew Pate and John Pate Executors of therein named Cert ificate is granted them for obtaining a Probate thereof in due form they h aving first made oath entered into and acknowledge Bond according to Law a nd it is advised that James Pursel (?) Absalum Smith David Meade & Dabn ey Shrewsbury or any three of them being first duly Sworn do appraise t he Personal Estate and Slaves of said decedent and make return there of to Court H Bowyer CBC
