The farm referred to on these plans is the farm my great grandfather, William Henry Edward BROOKS [William Henry Edward BROOKS, a7b1, (1875-1960)] owned and that my grandfather was given as per Deed of Transfer No. 29070/1954.

William Henry BROOKS, born 20 MAY 1875 transfer property to Albert Edward BROOKS, born 31 JAN 1919 on 6 JUL 1954. (1)Described as Portion C of the Eastern Portion of the farm Vergenoegd No. 3 situate in the district Marico measuring 6 Morgen, 15 square roods, extending as certificate of registered title No. 3008/1930 with diagram annexed [See descriptions Plan 1 and Plan 2] made in favour of the Government of the Union of South Africa, on 25 MAR 1930, and one subsequent Deed being Crown Grant No. 386/1954 this day made in favour of Appearer's Prinscipal, will more fully point out. Specially subject to and entitled to the following servitudes:- of The property transferred hereunder and the properties held under paragraph (2) and (3) hereof. Portion E of the Eastern Portion of the farm Vergenoegd No. ..., situate in the district of Marico, held under certificate of Registered Title No. 3008/1930. (c) Portion B of the Eastern portion of the farm Vergenoegd No. 3, situate in the district of Marico, held under Crown Grant No. 140/1930. (d) The Remaining Extent of the Eastern portion of the said farm, measuring as such 174 morgen 588 square roods, held under Deed of Transfer No. 7056/1907. (e) Portion A of the Eastern Portion of the farm Vergenoegd No. 3, situate in the district of Marico, held under Crown Grant No. 31/1953. (f) The Remaining Extent of the Western portion of the said farm measuring as such 579 Morgen, 552 square roods, held under Deed of Partition Transfer No. 9602/1911. (g) Portion 10 of the Western portion of the said farm held under Crown Grant No. 142/1932, shall jointly keep the graveyard situate on that portion of the Western portion of the said farm called "Weigrond" fenced and in good order. This transfer is further made subject to:- The rights of the Governor-General described in sections 31 and 34 of the land settlement Act, 1912, including reservation of mineral rights in favour of the Crown as will more fully appear from Certificate of Rights to Minerals No. 636/1954 RM registered this day. (iv) the division and distribution of the water available for use of the Eastern portion of the farm Vergenoegd No. 3 as between and among the lessees and/or owner of portions of the said Eastern portion of the said farm namely:- Portion A in extent 28 morgen 324 square roods Portion B in extent 6 morgen 152 square roods Portion C in extent 6 morgen 15 square roods Portion D in extent 36 morgen 416 square roods and the Remaining Extent in extent 174 morgen 588 square roods, shall rest with the Minister of Lands. C. subject to the usufruct of the said William Henry BROOKS (born 20 MAY 1875) and Magrietha Wilhelmina BROOKS (born PRIDDLE on 2 JAN 1882) married in community of property to the said William Henry BROOKS, this day registered under No. 1076/1954 S. and further subject to such conditions as are mentioned or referred to in the aforesaid Deeds.

(2) Certain Portion D of the Eastern portion of the farm Vergenoegd No. 3, situate in the district of Marico measuring 36 morgen, 416 square roods extending as certificate of Registered Title No. 3008/1930 with diagram annexed thereto, made in favour of the Government of the Union of South Africa on 25 MAR 1930 and 1 subsequent Deed being Crown Grant No. 386/1954 this day made in favour of Appearer's Principal, will more fully point out; A. subject to the conditions set out under paragraph (1) A. and B. which include reservation of mineral rights in favour of the Crown as will more fully appear from certificate of rights to minerals No. 636/1954, registered this day subject to the usufruct of the said William Henry BROOKS (born 20 MAY 1875) and Magrietha Wilhelmina BROOKS (born PRIDDLE on 2 JAN 1882) married in community of property to the said William Henry BROOKS this day registered under No. 1076/1954 S. and further subject to such conditions as are mentioned referred to in the aforesaid Deeds.

Certain 1/2 share in the remaining extent of the eastern portion of the farm Vergenoegd No. 3 situate in the district of Marico measuring as such 174 morgen, 588 square roods; extending as deed of transfer no. 2311/1891 with diagram annexed thereto, made in favour of Johan Georg Hermanus VILJOEN on 27 OCT 1891 and 2 subsequent deeds the last of which crown grant no 386/1954 this day made in favour of appearer's principal, will more fully point out;

the remaining extent of the eastern portion of the farm Vergenoegd No. 3, district of Marico (1/2 share of which is hereby transferred) is specially subject and entitled to the following servitudes: The remaining extent of the eastern portion of the farm Vergenoegd No. 3, district of Marico, as undivided 1/2 share which is hereby transferred, is subject to a servitude of abutment in respect of a dam in the Vergenoegd spruit in favour of the owners of portions measuring 240 morgen 295 roods and 444 morgen 239 roods of the farm DE RUST No. 57, district of Marico, as will more fully appear from Notarial Deed No. 355/1913, registered 18 DEC 1913.

(ii) The owners of (a) Portions C and D of the Eastern Portion transferred as aforesaid and the Remaining extent of the Eastern Portion of the farm Vergenoegd No. 3, district Marico, an undivided 1/2 share in which is hereby transferred. (b) Portion B of the Eastern Portion of the farm Vergenoegd No. 3, District of Marico, held by crown grant No. 140/1930 (c) Portion A of the Eastern Portion of the said farm held under crown grant No. 31/1953 (d) The remaining extent of the western portion of the said farm measuring 579 morgen 552 square roods held under deed of transfer 9662/1911 (e) Portion 10 of the western portion of the said farm held under grant no. 142/1932 shall jointly keep the graveyard situate on that portion of the western portion of the said farm called Weigrond fenced and in good order. B. subject to conditions (i) to (ix) set out under paragraph (1) B hereof which include reservation of mineral rights in favour of the crown as will more fully appear from certificate or rights to minerals No. 636/1954 registered this day. C. subject to the usufruct of William Henry BROOKS 9born 20 MAY 1875) and Magrietha Wilhelmina BROOKS (born PRIDDLE on 2 JAN 1882) married in community of property to the said William Henry BROOKS, this day registered under No. 1076/1954 S. and subject further to such conditions as are mentioned or referred to in the above Deeds. Where off the Appearer, renouncing all the right and title which his said Principal heretofore had to the premises, on behalf as aforesaid, did in consequence also acknowledge the said William Henry BROOKS to be entirely dispossessed of and disentitled to the same; and that by virtue of these presents the said Albert Edward BROOKS his heirs, executors, administrators or assigns now is and henceforth shall be entitled thereto conformably to local custom; government, however, reserving its rights; and finally acknowledging Transfer Duty to have been paid on the sum of £750 being fair and reasonable value and further appeared before me, the said assistant registrar of deeds, the said George Gadney DENOON, he, the appearer, being duly authorised thereto by virtue of a special power of attorney granted to him by Albert Edward BROOKS, born 31 JAN 1919 and signed at Zeerust on 30 SEP 1954. And the said Appearer, on behalf of his aforesaid principal, hereby declares to accept the aforesaid donation of the property hereby transferred subject to the usufruct aforementioned. In witness whereof I, the said assistant registrar, together with the appearer have subscribed to these presents and have caused the ... of Office to be affixed thereto.
