  • The accused, a 40-year-old man, initially stood trial on a total of 17 charges. At the start of the trial the first three charges were withdrawn by the State while the accused at the end of the state case was also dismissed on charges 4, 5 and 6.
  • I am therefore satisfied that the State has proved the following facts beyond reasonable doubt:
  • 1. The accused was arrested on Thursday, 25 April 2002, near the homestead of the deceased by inspector Le Roux, assisted by inspector Braaf and sergeant Basson where he was hiding under a bush.
  • 2. He had in his possession a .222 rifle of the deceased.
  • 3. During vizentering, during arrest a further .222 cartridge was found in his shirt pocket.
  • 4. After his arrest, the accused offered to show further firearms to the police which he did the next day.
  • 5. During the evictions, a large amount of things belonging to the deceased were found including the three firearms and ammunition.
  • 6. Also during the pointing out, the accused made certain incriminating comments and admissions made against Captain Huisamen which unequivocally indicates that the accused the goods in question removed from the deceased's residence.
  • 7. The deceased died as a result of certain serious head injuries which were probably inflicted with the axe which visible in photographs C21 to C24, was inflicted by the accused.
  • Based on these findings of fact, the following inferences are made as the only reasonable inferences:
  • Firstly, that the accused did enter the house of the deceased with the intention of killing the deceased rob. Attorney Theron. on behalf of the State, rightly conceded that the element of burglary not by the State is not proven.
  • Secondly, that the accused assaulted the deceased probably with the relevant ax and his hands and feet tied in order to overcome any possible resistance.
  • Thirdly, that when he assaulted the deceased, he had the direct intention to kill him.
  • Fourthly, that the accused removed all the items mentioned in the indictment from the deceased's house and that hidden in the places where it was later found.
  • Finally, that the accused removed the firearms and ammunition with the intention of controlling them take or exercise over it and that he therefore possessed it without having the necessary license or permit to do so to own.
  • In the light of these findings which I have just set out, the following order is made:
  • On charge 7, illegal pointing of a firearm, the accused is ACQUIRED.
  • On count 8 the accused is found GUILTY find to murder, as charged.
  • On charge 9, the accused is found GUILTY to aggravated robbery.
  • On counts 10 to 17, the accused is found GUILTY found, as charged, due to illegal possession of the firearms and ammunition mentioned in the charge sheet.
