Address at death, Dane Bank, Congleton, a Georgian house which it would appear he inherited in a rather dubious Chancery case in 1833. 1841 and 1851 censuses show him at Dane Bank. Died age 77.

Abstract of John's will, made 14 May 1851, gives all his estate to his valued friend Joseph Bullock of Congleton, surgeon, on Trust, for the benefit of his wife, Elizabeth Malbon, during her lifetime and thereafter; his household effects to his daughter Elizabeth, his other effects to be realized to provide: 1000 pounds for his daughter Eliza, 2000 pounds for his daughter Hannah Louisa, the residue to be divided equally (sevenths) between his son John Miller Malbon, his daughter Ann Lucretia the wife of Richard Cox, his son William Malbon, his daughter Millicent Caroline, Charlotte Maria wife of Prosper Haslam, his daughter Emily wife of Peter Lucas, and his son Joseph Frederick Malbon.

Executors Joseph Bullock, Elizabeth Malbon and Hannah Louisa Malbon. Issued 23 Apr 1852. Sarah: Daughter of John and Susannah Spurr who married in 1765 -- a brother, John, b.1766. Elizabeth: died age 67. [All above from Malbon family tree, Holliday , pp. 9-10]

Obituary Notice from Macclesfield Courier and Herald: 28 June 1851: On the 24 inst. in the 78th year of his age John Malbon Esq. of Dane Bank, Congleton. [Note: Died only 24 days after his wife, and son John Miller Malbon died only a few months later.] M.I. -- on south side of tomb of Ralph Malbon, schoolmaster -- see wife Elizabeth's notes.

Malbon family tree for Chancery suit, 1833: "In the Grindon Register by which the Defendant John Malbon hold possession of the Estate, it is therein stated that it is a John Malbon married to a Martha Wardle and not George, as he is put in the claim , therefore it is a forgery. See the Grindon Register."

Lived on York Street, Nottingham in 1826. Inherited tailor's business and freehold from his father, John Malbon, on his death in 1830.

In 1831 moved to Eaton Cottage, on the Dane Bank Estate in Congleton, to pursue his claim to inheritance of the Dane Bank Estate. See Barbara Lynch, The Malbons, page 208.

The Court of Chancery

On 11 December 1826, in Congleton, Cheshire, an event occurred that would not only spread enmity and discord throughout the Malbon family but also exhaust the finances, patience, courage and hope of several of its members in the process.

On that date, William (Gorst) Malbon died at Dane Bank House, on the outskirts of Congleton, unwed and childless, leaving behind him rich estates in Cheshire and Staffordshire, the rightful heir to which was far from clear. The task of determining the identity of that €œ'right heir' would occupy several firms of solicitors and the Court of Chancery in London for eight long years, bringing to winner and losers alike the heartbreak so vividly evoked by Dickens's novel Bleak House.
