Biography

John Paine, son of Ralph and Doritha Paine, was born about 1685.[1]

He married Rebecca Davis, daughter of William Davis and Mary (Makepeace) Davis, on 31 Oct. 1705 at Taunton, Bristol County, Massachusetts. [2]

He wrote his will dated 5 Feb. 1763, almost three years before his death[1] on 17 Dec. 1765 at Freetown, Bristol, Massachusetts. He was buried at Paynes Cove Cemetery, Freetown, Bristol County, Massachusetts. His memorial has biographical material the links to that of a family member seems to be an error.[3]

3. JOHN PAIN, (Ralph), was born probably in Rhode Island about 1681-84, and died in Freetown MA 17 December 1765. He married in Freetown on 31 October 1705 REBECCA DAVIS, who was born probably in Freetown about 1682-86, and died in Freetown after 2 October 1771 and likely before September 1774. She was the daughter of William and Mary (Makepeace) Davis of Freetown. John, always described as "yeoman" in deeds, worked with his father in farming their part of the Nineteenth Lot. Having received part of his patrimony shortly after his marriage in some unrecorded fashion, John received the rest by deeds in 1720 and 1722, and by his father's will. [BCD 13:328, 14:364.][8]]

John's few land transactions mostly involved family. While their father was still alive in 1726, John purchased part of his brother Joseph's property. In February 1729/30 he sold to his brother Thomas for 30£ the six acres of land on Bryant's Neck that included the family cemetery which his father had given him in his will. The cemetery was across Paine's Cove from his farm. And as his father had done for him, he sold his son, John "Junr., Boatman" 30 acres of his farm for 100£ old tenor on 8 March 1745/6, land his son, almost eight years married by this time, was already living on. [BCD 17:91, 21:19; 36:372.][8]

Just three transactions involved his neighbors. In 1716 he sold the "head of the half Lot...[where] I now live" to Jacob Hathaway of Freetown, yeoman for 20£ 12s. (This must have had his father’s approval.) In October 1729 he bought from Lot Strange of Freetown, cooper, 10 acres for 90£, it "being a part of the Southernmost half share of ye Nineteenth Lott..." From its description, it would appear this is the land (plus 2 acres) Strange had acquired from John's younger brother Joseph on 5 April 1725 for 24£ current money (see Joseph's record). That deed had reserved a cartway for John; this tidied up the matter. Finally, in 1750, John sold 16 acres of the Nineteenth Lot for 300£ to neighbor Philip Hathaway, acreage bordered on the north and south by Hathaway property with the "Countrey Road" on the west. [BCD 12:176, 19:274, 39:285.][8] All in all, these transactions seem to have straightened out property lines as well as familial relationships. John held few and only minor town offices, and never seems to have had anything to do with the county courts. His will, dated 5 February 1763, proved 6 May 1766, disposed of "the worldly state ye Lord hath Lent me" as follows:

1. wife Rebeckah Pain to have use of all his lands, buildings and movables for her natural life, excepting what the executor needs to settle probate, any "overplus" on the settlement to be paid her by the executor within one year after John's death;
2. his two grandsons John and Ebenezer, "my Late Son John Pains Two Sons” to have the south half of his half share of land in Freetown to be equally divided between them, after Rebeckah's death;
3. granddaughters Mary and Abigail Pain, his son John's two daughters, to receive one dollar each from his estate at age eighteen, brother John to pay Mary and brother Ebenezer;
4. grandsons Solomon and John, "my Late Son Solomon Pains Two Sons," to have the northerly half of my half share of land in Freetown after Rebeckah’s death;
5. granddaughter Lydia Pain, only daughter of Solomon, to receive two dollars from his estate at age eighteen, payable by each of her brothers;
6. daughter Sarah Witherell, widow of Seth, one seventh of his movable estate remaining after her mother's death;
7. daughter Phebe Douglas, wife of Hugh, one seventh also;
8. the children of his late daughter Rebecca Baggs, one seventh also to be divided equally among them;
9. the children of his late daughter Elisabeth Davis, one seventh also to be divided equally among them ;
10. the children of his late daughter Mary Witherell, one seventh also to be divided among them equally;
11. the children of his late daughter Margaret Pierce, one seventh also to be divided equally;
12. the children of his late daughter Priscilla Cleveland, one seventh also to be divided equally;
13. his Negro man, called Nero, his freedom after Rebeckah's death;
14. his eldest son John Pain to be executor;
15. the executor to set engraved stones upon the grave within a year, and if he neglects, then "Kinsman Ralph Pain Should Cause ye Same to be Done & be Paid” for it by the executor.

Witnesses were Samuel Freeman, Meres {Morris?} Gilbert and John Crane. [BCP 10:30, 11:277, 309; 19:410, 412. [9]] See also file papers under "John Pain, Freetown, 1767." That file date refers to the year of Ralph Pain II's appointment as guardian for John Paine, his cousin Solomon's son, and not to John Sr.'s death, though his original will is filed with this guardianship.]

Rebecca lived well into her nineties. She was eventually taken care of for two years by her daughter and son-in-law, Phoebe and Hugh Douglas, under a court ordered guardianship. The selectmen of Freetown petitioned for this arrangement on 2 October 1771. Acting on a complaint to them about her condition, they found her "so far advanced in old age that she is not capable of Taking Care of herself and Estate." John Hathaway of Freetown was appointed her guardian. He finally submitted an account to the court on 30 July 1776. For the two years he managed her affairs, her estate had generated £42.18.5: her grandson John Pain had contributed £5.13.3; Ralph Pain, her nephew by marriage, £1.16.6; the farm had been rented for the two years for £24 total; there was a debt note for 12 shillings; and Nero, John's slave, bought off his time for £7.4.0. Costs included paying the town its taxes, for hiring the farm out and writing the lease (4 shillings 4 pence), for Hatheway's plow team for two days (12 shillings), to the Douglases for "Keeping & Boarding sd Non Compos 2 years" (£31.4.0), and other sundries, for a total of £35.15.7. The court allowed the account. Who received the estate's remainder was not noted. [BCP 22:20; 24:229.[9] There are no file papers under "Rebecca Paine, Freetown, 1771”.]
