"SUPREME COURT Sittings in Banco....THURSDAY, 30th MARCH, 1837. ...Platt v. Platt.- This was a case in Equity, brought before the Court for the purpose of obtaining a decree to determine the meaning of the last Will and Testament of John Laurie Platt, deceased, of his Free- hold Estate, situate upon the Hunter, and known as the Iron Bark Creek Farm, con- sisting of 2,000 acres, and his personal pro- perty amounting to £1,000. The Will con- tained two clauses, which it was contended were of a contradictory nature ; the first clause granted two-thirds of whatever pro- perty the deceased might possess among the children, and the remaining one-third to Rosannah his wife. In the body of the Will it waa also expressed as the wish of the Testator, that his eldest son, Frederick William Platt, should retain possession of the Freehold Estate at a valuation, and to give auch a sum towards tho purchase of 2,000 acres of land as the Executors shall consider fair and reasonable for each of his brothers. This was an amicable suit, in which the whole Bar was engaged. Reserved for consideration."
Followed by, in "The Sydney Herald" of Monday 3 April 1837:
"LAW INTELLIGENCE. SUPREME COURT-CIVIL SIDE. THURSDAY, MARCH 30-In Equity-Before the three judges. Platt v Platt- In this case a bill had been filed by the plaintiffs, the younger children of the late Mr. and Mrs. Platt of Iron Bark Creek, Hunter's River, calling on the defendants, the eldest son und executors of Mr. Platt, to sell the estate of Iron Bark for their benefit. The question for the judges to determine was, whether it was the intention of the late Mr Platt to leave his landed property entirely to his son, or only an equal share with the other children. After hearing the arguments, the Court said they would take time to consider their decision. Counsel for the infants, Messrs. Kerr, Foster, and Windeyer ; For the heir, the Attorney. General, and Messrs. S Stephen and Therry ; for the executors, Mr. Carter."
