Will of John Supler Decd.

In the name of God Amen. I John Suplar of Donegal Township Washington County Pennsylvania being of sound mind and judgement do constitute this my last will and testament in form following. First I bequeath my soul to God who gave it and my body after my decease to decently intered in the ground respecting my worldly property I direct that all my lawful debts my doctors bill and my funeral expenses be paid out of my moveable property I bequeath to my beloved wife Rachel Suplar all my real and moveable property during her lifetime and at her decease to be divided among my children in the following manner. To my youngest daughter Ann I bequeath one horse and cow one bed and beding (sic) one saddle and one bureau after which I direct that all remaining property both real and personal be equally divided between my children namely my three sons John, Samuel and Edward my five daughters Susana, Margaret, Sarah and Anna who are now living and my daughter Rachel who is deceased her share to be paid to her children and I hereby appoint my son John Suplar and my good friend David Wallace Executors of this my last will and testament In In testimony whereof I have hereunto set my hand and affixed my seal this fourth day of June A. Washington County ss. Be it remembered, that on the 19th day of June, A. D. 1835, before me John Grayson, Register for the probate of wills and granting letters of administration in and for said county in the commonwealth of Pennsylvania, came Benjamin Potter and Robert Chase, witnesses to the within instrument purporting to be the will of John Suplar decd. who on their oaths administered as the law directs, do dispose and say, that they were present and did see the testator therein sign this will, and did hear him publish, pronounce and declare the same as his last will and testament; that they signed it as witnesses at his request and in his presence, and at the time thereof he was of sound and disposing mind, memory and understanding, to the best of their knowledge, observation and belief Benjamin Potter, Robert Chase. And sworn to and subscribed before me Jno. Grayson, Regr.

June 19, 1835. Letters Testamentary with copy of the will and probate annexed, issued to John Supler, executor therein named, who on the same day was duly sworn. Jmo Grayson, Regr.

The petition of John Supler of Richhill Township, Greene County, Pennsylvania, eldest son of John Supler, late of Donegal Township, Washington County, State aforesaid, farmer, deceased, humbly sheweth:

That the petitioners said father died in the early part of the summer of the year 1835, leaving surviving here his wife, Rachael Supler and seven children, viz: John, Samuel, Edward, Susannah, Margaret, Sarah and Anna; and grandchildren, the issue of his daughter, Rachael who was then deceased. That the said John Supler sometime prior to his decease, to wit: on the 24th day of June A. D. 1831, made, published and declared his last will and testament, duly proven and registered at Washington, in the county aforesaid, on the 19th day of June A. D. 1835 wherein said whereby he gave, devised and bequeathed, after the payment of his lawful debts, Doctors bill and funeral expenses, all his estate real and personal, to his wife Rachael Supler, to be held and enjoyed by her during her lifetime; and at the decease of his said wife devised and bequeathed the same to his children, to be divided among them in the following manner to wit: to his youngest daughter he bequeathed one horse, one cow, one bed and bedding, one saddle, one bureau, -- after which he directed that all his remaining property, both real and personal, should be equally divided between his children, that his three sons, John, Samuel, and Edward, and his five daughters Susannah, Margaret, Sarah, and Anna, who were then living, and the children of his deceased daughter Rachael, the said children to receive the share of their deceased mother. That the said John Supler died seized in his demesne as of fee of and in a certain message and tract of land situate in Donegal Township and County of Washington, containing (133) acres-- one hundred and thirty three acres and (147) one hundred and forty seven perches, strict measure and adjoining lands of Isaac Kirk, John Craig, James Roney, Wallace's heirs and William Patterson's heirs with the appurtenances, and the said tract of land was the only real estate owned by the testator at the time of his death. That the said Rachael Supler, the widow of the said John Supler, has lately deceased, whereby his children and heirs became entitled to their respective shares according to the will aforesaid, That the heirs now reside and are described as follows:

1st Susannah intermarried with Benjamin Elliott, and now residing in Stark County, Ohio; 2nd Rachael's children, who was intermarried with John Potter, late of Marshall County, Virginia, deceased; the said Rachael died leaving ten or eleven children, and as far as known to the petitioner they are named and reside as follows, to wit: Pardon of Adams County Illinois; Amanda residing in Marshall County, Virginia; Mary, lately deceased, who was the wife of Ephraim Banning of McDonough County, Illinois, said Mary left issue one or two children whose names are unknown to the petitioners; Rachael Hubbs, lately deceased, who was the wife of of Isaac Hubbs, of Marshall County, Virginia -- said Rachael left issue two children the names of whom are unknown to the petitioners; Margaret now lately deceased without issue it is alledged; Uriah of Adams County, Illinois; John of the same County and State, but recently gone to the state of California; Samuel, of Adams County, Illinois; Anna, wife of John Porter, of Donegal Township, Washington County, Pennsylvania; Sarah intermarried with a man of the name of _______ Bartlett who resides in the County of Adams and state of Illinois; Eveline and William, living in Donegal Township, Washington County, Penna, -- all the children of the said Rachael being of age except William, who is within a few months of twenty one years.--3rd Margaret, wife of Stoughton Porter, of Adams County, Illinois; 4th John, the petitioner of Richhill Township, Greene County, Pa.; 5th Sarah, wife of John Kimmons, residing in West Finley Township, Washington County, Pa.; 6th Samuel, residing in Logan County and state of Ohio; 7th Ann, wife of Isaac Kirk, of Donegal Township, Washington County, Penna; and 8th Edward Supler residing in Marshall County and State of Virginia.

The petitioner therefore prays the Court to award an Inquest to Partition of the premises aforesaid to and among the parties as above described and all persons having an interest therein, in such manner and in such proportions as by the said will and the laws of this Commonwealth is directed, if such partition can be made without prejudice to or spoiling the whole; but if such partition cannot be made thereof, then to value and appraise the Same, and make return of their proceedings according to law. And now May 24th A. D. 1851 Inquest awarded according to prayer of the petitioner. Afterward, June 3, 1851, Let Writ
