About Joseph Gregoire Guillory

The Avoyelles Parish, LA Guillory family stems from the immigrant, Simon Guillory, who was born 1646 at Chartres sur Cher, Diocese of Blois, formerly part of Orleans Province, now part of Loire at Cher (district 41), located just a five minute drive West of Vierzon, France. Simon arrived at the city of Quebec on May 25, 1664 aboard the ship, “Le Noir”, which had sailed from LaRochelle, France (letter from R.J. Auger, Archives du Quebec, to Byron Smith of New Orleans, LA., dated 29 Jan. 1975). On the 1666 Census of Montreal, GUILLORY is listed as a gunsmith, an employee of Charles LEMOYNE (Father of Bienville and Iberville).
Simon is the only GUILLORY listed in Tanguay (Dictionnaire Genealogique des Familles Canadiennes I, IV, 1957 reprinted) in the appropriate generation.

Simon Guillory and Louise Bouchard were married at Montreal, Canada on November 6, 1667. His age at the time was listed as 21. Louise was listed as being 20.

Simon Guillory was at Ft. Albany in 1682, after the fort had been taken by Lemoyne’s troops from the British, when the British took possession of the fort again from the French.
Simon was put in "irons" for murdering the surgeon & priest, at the fort, with an ax. The British took him to England as a prisoner but by 1696 (the year of his death) he was back in New France.

It was Simon Guillory’s descendant, Joseph Gregoire Guillory, son of Francois GUILLORY and Marie Jeanne Montfort, who moved his family, which was at Mobile, Alabama at the time, to the Opelousas area, and from there to Avoyelles Parish around 1787.

Francois Guillory had arrived in colonial Louisiana (Mobile, Alabama) c1707-1708 from Montreal and established himself on the eastern end of Dauphin Island (then called Massacre Island).

From the internet: “Francois moved to Massacre Island [Mobile, Alabama] and began planting vegetables. By 1710, he had built a house on the eastern end of that island, on the point given the name POINTE A GUILLORY. (The Names Pointe a Guillory, Passes a Guillory, and Isle a Guillory, appear on a map done in 1718, Jay Higginbotham, Old Mobile. Mobile City Museum, 1977, pp. 271, 345, 391, 393, 397f, 447f: Appendix, n.p.) However, it is possible that he remained unmarried for several years after founding a habitation on the island.”
What is known is that he was a sailor (mentioned as "matelot" on a note taken from page 27 Rencensements, a manuscript copy of French Archives at the Louisiana Historical Museum Library in New Orleans, LA.), seems to be the Francois baptized on 18 Mar. 1676 at Montreal, the son of Simon GUILLORY and Louise BOUCHARD..

A) JOSEPH (PIERRE) GREGOIRE GUILLORY born Dec 16, 1712 at Dauphin Island, Mobile, AL died March 28, 1786 at the age of 74 in Grand Prairie, St.Landry Parish, LA.
His bride, Marie Jeanne LACASSE, daughter of Jean LACASSE and Marie Ann FOURCHE, had been born in Mobile on March 20, 1726, and baptized that same day.

In 1737, at the age of 11, Marie Jeanne LaCasse had married Joseph STAMAYER /Estamier dit Chateauneuf, a soldier in Lesuer's company; but was soon widowed.

Marie Jeanne LaCasse was not yet fourteen years old at the time of her second marriage to Joseph Gregoire Guillory.
Marie Jeanne Guillory died at the age of 38, on April 27, 1764 at Mobile, AL, after giving Joseph Gregoire eight children.

By the time of her death in April, 1764, she produced at least eight children, only one of these pre-deceasing their mother (Marie-Louise, b. June 1748, d. May 1749.) Her parents were living at Fish Island [south of St. Augustine, FL] at that time.) These records are from the Mobile, Alabama, Church Archives.

Marguerite Folse was the daughter of Joannes Jacobum Folse/Foltz (born ca 1697 in Ramstein, Bavaria, Germany and baptized on Jan 27, 1697 in Ramstein, Bavaria, Germany. He died on June 10, 1746 at Edgard, St. John Baptist Parish, LA,, and was buried on June 11, 1746 in Edgard, St. John the Baptist Parish, LA) and Catherine Benick (born date unkn in Buchen, Baden, Germany, died Dec 17, 1748, St. John the Baptist Parish, LA.) It was Jean Baptiste Guillory who moved the family to what later became Avoyelles Parish.

Speaking of his daughter’s death, Joseph Gregoire said, The child died in my absence, he said, Only my wife and an old man named Dauphin (probably a slave) was there. They had to bury her because they could not carry her body to the fort.

JEAN LOUIS GUILLORY SR and MARIE JEANNE FONTENOT had twenty-one children

Joseph moved his family, including slaves, to Opelousas, Louisiana after Jeanne's death.
He had recently received a land grant of some 640 acres there. Before the move, Joseph was having an affair with his slave, Marguerite; she was pregnant during the move to Louisiana. In the ensuing years, Marguerite gave Joseph Gregoire three additional children. Around 1770, Joseph began proceedings to free Marguerite and her children - yet paperwork that was drawn up turned out not to be legally binding. A legal case ensued where Marguerite fought to free herself, and then her four children, from slavery from Joseph Gregoire's legitimate children. This was known as "The Margarita Case".

GUILLORY FAMILY: THE MARGARITA CASE:
“It is not known if Marguerite gave birth to the child she was carrying before arriving at Opelousas Post. It is now assumed, however, that the child Marguerite was carrying was "Catherine" (called Catiche), born c1764, fathered by Joseph Gregoire Guillory.
After the move to Opelousas Post, Marguerite produced three additional children fathered by Joseph Gregoire: Jean Baptiste (c1766), Joseph (c1769), Marie (c1770). (The fact that Joseph Gregoire Guillory was the father of Marguerite's children was never disputed.) After the birth of Marie in 1770, Joseph Gregoire Guillory went thru the motions of freeing his Negro mistress and their children. At the same time, he convinced his legitimate children (who owned an undivided half interest in the slaves) that he was capable of paying them their portion of their deceased mother's estate without having to sell the slaves or divide them between the heirs.
Joseph Gregoire Guillory then had a local schoolmaster draw up the emancipation paper. However, unbeknownst to Marguerite, the document was technically invalid because the schoolmaster was not qualified to officiate at the manumission. Whether Joseph Gregoire was aware of this fact is unclear. However, as stated by Winston Deville in the article entitled "The Margarita Case: Historical Perspectives on a Controversial Case in 18th Century Louisiana" (Louisiana Bar Journal, Volume 31, Number 2):
The case was not fully settled until 1783; Marguerite and her children had won their freedom.”
