Wikipedia gives the date of death for this Malise as 1357, assigning the death at Neville's Cross to his brother in law Maurice de Moray. MALISE ([1275/80]-before 1329). Andrew Wyntoun´s Cronykil records that "Jhon and Alysandyre" had five sisters, the second of which married "Off Stratherne the Erle Malys" by whom she had "a swne…Malys"[732]. He succeeded his father in 1313 as Earl of Strathearn. m firstly AGNES, daughter of --- (-after Aug 1320). John of Fordun´s Scotichronicon (Continuator) records that "dominus Willelmus de Sowlis et comitissa de Strathern" were convicted of high treason at a parliament in Scone in Aug 1320 and sentenced to life imprisonment[733]. m secondly ([1323]) as her first husband, JOAN Menteith, daughter of Sir JOHN Menteith of Rusky & his wife --- (-after 20 Mar 1367). She married secondly John Campbell Earl of Atholl, thirdly Maurice Moray Earl of Strathearn, and fourthly (before 9 Nov 1347) as his second wife, William Sutherland 5th Earl of Sutherland. Earl Malise & his first wife had two children:

i) MALISE (-killed in battle Neville´s Cross 17 Oct 1346). He succeeded his father as Earl of Strathearn. He succeeded his cousin Magnus as Earl of Caithness and Orkney in [1323/29]. He resigned the earldom of Strathearn [24 Sep/16 Dec] 1332 into the hands of Edward Balliol, was tried for treason in 1344 for so doing, but found innocent[734]. John of Fordun´s Scotichronicon (Continuator) records that "Johannes Ranulphi comes Moraviæ ac etiam comes de Strathern constabularius Scotiæ…David filius et heres David de Lindsay…Willelmus Fraser…" were killed at Durham 17 Oct 1346[735]. [736]m firstly MARY, daughter of ---. m secondly ([1325/28]%29 MATILDA [Marjory] of Ross, daughter of HUGH Earl of Ross & his first wife Matilda Bruce (-after 1350). Earl Malise & his first wife had four children:

(a) MATILDA . m --- de la Arde .

(b) EUPHEME .

(c) AGNES (-before 1360). m ERNGILS, son of ---. He was granted the title of Earl of Orkney by the king of Norway in right of his wife but forfeited it in 1375[737].

(d) ISABEL . m Sir WILLIAM St Clair, son of ---. Lord St Clair.

ii) MARY . "Malisius comes Strathern" granted "terram de Abbercarny…que fuit Roberti filii Magni dicti de Strathern" to "Johanni de Moravia de Dromsygart…[et] heredibus suis de Maria filia nostra" by undated charter[738]. [739]m ([1319/22]) as his second wife, Sir JOHN Moray of Drumsagard, co. Lanark, son of ---.

VIII MALISE V, 8th Earl. From Dean Gules translation of the Orcadian Diploma we ascertain that King Magnus of Norway had directed the Lawman and Commons of Orkney to deliver to Earl Malise all charters, evidents, and letters of privilege pertaining to him concerning the Earldom of Orkney. Very little is known of this Earl. In 1334 he had endeavoured to recover Stratherne, which Earldom King Edward III of England had bestowed on Earl John de Warrenne, brother-in-law of Malise. He is supposed to have visited Norway about the same year, and in 1344 failing heirs-male, makes a special destination of the Earldom of Caithness to his daughter Isabella, who presently married Sir William St.Clair of Roslin, and, surviving all other issue of her father, died post 1404, transmitting her claim to that Earldom to her son Earl Henry II of Orkney, who allowed it to remain dormant, but the claim was successfully revived in the person of his son, Earl William, who thus became first of his line Earl of Caithness, anno 1455. The Diploma states that Earl Malise married, first, Joanna, daughter of the Earl of Menteith (perhaps his cousin), by whom he had -

MATILDA, married Weyland de Ard, and had an only child, ALEXANDER DE ARD, EARL OF CAITHNESS (1375) without issue

And secondly, Marjory, daughter of Hugh, Earl of Ross, by whom he had -

ISABELLA, married to Sir William St.Clair of Roslin, and had, with other issue HENRY ST.CLAIR, EARL OF ORKNEY, 1379.

ANNOT (or MERETTA), married Erengisle Suneson, Earl of Orkney by right of his wife, 1353-57, without issue

Daughter, married Gothorm Spar, and had SIR MALISE SPAR, CLAIMANT OF ORKNEY, slain without issue

EUPHEMIA, died without issue

The Earldom of Stratherne was apparently a male fief. Earl Malise is presumed to have died before 1345, in which year [his brother-in-law and cousin], Sir Maurice Moray, was created Earl of Stratherne, who falling at Durham the following year, the Earldom was given to Robert Stuart, first of his line King of Scotland, who, later on when he ascended the throne, assigned it to his brother David.
