Marshall Mullins was born in Pike County, Kentucky in 1823. When he was about seven years of age his parents and family (along with Elizabeth Newsome) and his half brothers and sisters, left Pike County to avoid a court summons. They ended up in Logan County, Virginia (now West Virginia). He married Nancy Roberts at Bend Creek, Logan Co., July 15, 1844. Nancy was born in March 1829 in either Pike Co., KY or in Virginia. She was the daughter of Isaac "Ike" Roberts and Dorcas Mullins (Isham's sister and the same Isaac and Dorcas that had been subpoenaed in Pike County in 1829) which means Marshall and wife Nancy Roberts were 1st cousins.
Marshall and Nancy, and the rest of the Mullins clan, returned to Floyd County, Kentucky in 1844/1845 and had ten children: Isham 1845, Isaac 1846, Dicy 1848, William M "Billy" 1849/1854, Eliza 1851, Marshall Jr. 1856, Catherine "Katy" 1859, Dorcas 1860, Nancy 1865 and Jacob 1867/1869.
According to Civil War pension records of 1879, Marshall enrolled at Louisa, KY, April 21,1863 in Company 'C' of the 39th Regiment of the Kentucky volunteers (Union army) and was honorably discharged at Louisville, KY on September 15, 1865. In 1879 he was living at Welch Glade, Webster County, WV. His son, Isham enlisted at the same time.
On June 11, 1864 he mustered into "C" Company Kentucky 39th Mounted Infantry. He deserted on Aug 11, 1864, but returned on Oct 6, 1864 to "C" Company. He was court-martialed and sentenced to forfeit pay to Oct 6, 1864.
The circumstance surrounding Marshall Mullins desertion from the Union army appears related the Battle of Louisa, August 8-9, 1864 which occurred two days before Marshall and 130 to 150 others deserted. A newly formed black regiment of the Union army approached Louisa, Kentucky when shots were exchanged between the 39th Infantry and the 109th U. S. Colored Infantry Regiment, both of the Union Army.
