To the Hon: ??Jnoll?? Green judge of the superior court of chancery for the Fredericksburg district Humbly complaining ??sheweth?? unto your Honr. your orators and oratrixes Charles Thornhill and Hannah his Wife formerly Hannah Minter, Sally Robinson, formerly Sally Minter, and Edward Minter, that Joseph Minter died in the county of Fauquier about the year 1817 that his children now living and the descendents of sudh of them as are decd. are as follows your oratrixes Hannah Thornhill, Sally Robinson widow of James Robinson, orator Edward Minter, also Joseph Tomlin Minter, and the children of his deceased daughter Mary White to wit Armstrad White, Sarah Leach formerly Sarah White who married Elijah Leach, Nancy Leach formerly Nancy White who married Thornton Leach, Elizabeth Bradford formerly Elizabeth White who married Wm. Bradford That the said Joseph Minter duly made and publish'd his last will and testament on the 17th day of Augt. 1805 which after the death of the testator was proved and recorded in the county court of Fauq. and letters executorial ??thereas?? granted to Thos' Hunton one of the ??exors?? therein named, who some time thereafter caus'd the same to be revoked without giving any acct of his proceedings therein - Under a plea as your orators and oratrixes are inform'd that all the estate of the sd. Joseph Minter was claimed by his son Joseph Tomlin Minter by virtue of the ??the?? deeds hereto ??annesed?? markd B. & C - and by other pretences which they deem totally inadmissible - Your orators proceeding farther state that the said deed for four negroes and the household & kitchen furniture of the said Joseph Minter dated 23rd of Sept. 1814 was obtained by the sd. Joseph Tomlin Minter with the ??assertance?? of his confederates by the grossest fraud your orator & oratrixes ??assert?? and will be enabled to prove in due time that the said Joseph Tomlin Minter avail'd himself for the purpose of getting the s'd deed executed of a season when his father the said Jo. Minter who was far advanc'd in age was incapacitated by a long spell of intemperance from performing with a reasonable discretion the act by which the his said son claimd the afores'd property - And that the condideration of support therein mention'd, was a mere pretence to cover a fraud too gross for naked exhibition - your orators & oratrixes farther state that the balance of the personal property not named in the said deed was considerable, that no ??acer?? thereof has been rendered hither by the said Joseph Tomlin Minter or by the sd. Thos' Hunton - They therefore pray that the sd. Minter & Hunton may be made defd't hereto, that they may ??well & truly?? on oath state what property of the sd' Jos. Minter has come into their hand, that the sd. deed may be set aside as fraudulent & that a division & payment of the same may be ordered according to the directions of the sd. Will - your orator also state that the sd. J. T. Minter conscious of his fraud and fearful of the consequences has endeavored to buy his peace by delivering up according to the direction of the will to the children of the your oratrix Sally the negro boy Sampson in the will mentioned for which reason they are not made parties in this suit your orators also pray your honor to do unto them such other & farther justice to your honor shall seem meet & equitable.
