Lady Mary Maitland, here treated, is reported to be the second daughter of Charles Maitland, 3rd Earl of Lauderdale The Scots Peerage VIII: 72 According to the late Alan S. Carnegie, Lady Mary was erroneously identified as the daughter of William Maitland and the granddaughter of Charles Maitland, 3rd Earl of Lauderdale in J. R. N. Macphail's account of the family for the Scots Peerage. The Scots Peerage V: 309 Alan S. Carnegie's assertion is confirmed by an Act of Commissioners of Equivalent dated 13 October 1707, which identifies Lady Mary as the brother of William Maitland NRS: RH15/33/8

13 October 1707: Extract act of Commissioners of Equivalent intimating a bond and translation, 10 May 1707, by Mary, countess of Southesk, and Mr. William Maitland, her brother, to John Montgomery, W.S., and Alexander Campbell, factor, merchant in Edinburgh, of £1000 subscribed by deceased Charles, earl of Southesk, in Capital Stock of Indian and African Company.
