About Peter Helton, II

Peter Helton (Peter I) b. c. before Feb. term of Court 1803 when his will was proved in Orange Co., NC his will was dated Dec. 20 1802. He had three sons and eight daughters.

The following is a copy of the will of Peter Helton (Hilton) II.

In the name of god Amen. I Peter helton in the County of Orange State of N.C. being sick in body but of perfect mind and memory thanks to God & calling to mind the mortality of my body & knowing that it is appointed for all was once to die do make & ordain this my Last Will and Testament that is to say first of all I give and bequeath my Soul in the hands of Almighty God who gave it and my body to the Earth to be buried in a decent form at the direction of my Executor Nothing Doubting Ect.

And as touching such workly estate wherewith it hath pleased God to bless me with in this life I dispose and desire in the following form. first I give and bequeath unto beloved wife Susanna one horse creature she take choice of all I have also two cows the choice of all i have. Bed 7 furniture & as much of the Household firniture as she thinks needful for her use also my Old plantation whereon I now live with all the buildings thereon & the privilege of timber to support the fencing 7 fuel during her life time the Household furnishing she may dispose of to whom whe sees cause.

(Secondly) I give and bequeath unto my son Abraham Helton one Hundred A. of lands to be surveyed of the tract I own including the improvements he lives on to his & his heirs forever.

(Thirdly) I give and bequeath unto my son Peter Helton one Hundred acres of land to be surveyed of the tract including the improvemnts he formerly lived on to his his heirs & assigns forever.

(Fourthly) I give a bequeath unto myh son James Helton ohe Hundred and twenty acres of land including the old plantation his said James to enjoy the said lands & promises he 7 his heirs & assigns forever. And as to the other part of my moveable property which is not disposed of I request to be sold at public sale & after my lawful debts are paid to equally divided between my daughters which is in number eight to be equally divided among them and will be their portion. And I also appoint & Nominate Samuel Fogleson & John Coble, son of Adam to be my Executors to have this my last will & testament put in execution and performed. Whereunto I the aforesaid Peter Helton do acknowledge this my last will and testament in the presence of the witnesses. I have set my hand and seal this twentieth day of December in the year of our Lord one thousand eight Hundred & two.

North Carolina Orange County I, A.W. Kenion, Clerk of the Superior Court of Orange County, and State of North Carolina do hereby certify that the foregoing is a true copy fo the last will and testment of Peter Helton as the name appears on record is my office, recorded in Will Book D at page 92. Witness my hand and official seal this 2nd day of August, 1935 Clerk Superior Court A. W. Kenion
