Philemon Waters I and Mary's known children are:

  1. 1. Mary Waters born c 1709. She married Edward Askins and had a child by 1730 when Philemon Waters I deed to her & her child, Philemon. There were probably other children. This family needs more research.
  2. . Philemon Waters II was born 8 October 1711 in Stafford County, Virginia. He married c 1730-31 Sarah Bordroyne. She being called a French Huguenot, but I have been unable to find her family. See next chapter.
  3. 3. Thomas Waters born c 1714. He appears to have been married twice. The child Philemon Waters born 1739 was born to Thomas Waters per Overwharton Parish Records. By 1748 his wife is Elizabeth and he has a son born 10 March 1750/51 that he names Philemon Waters. The 1739 Philemon must have died as a child. This Philemon born in 1751 was a Kentucky hero as was his first cousin, Col. Philemon Waters of South Carolina. Thomas & Elizabeth moved into Frederick County, Virginia by 1748 when they sign a deed with Brother Philemon II and his wife Sarah Bordroyne. Thomas Waters appears on the 1744 Tax List for Frederick County, Virginia. The deed will be be given under " Lands of Our Fathers" Thomas died 1760 in Frederick County, Virginia.
  4. 4. John Waters -- born 1717 -1727. John married Christian ____?. He first appears in the Pr. William County Court Records in 1753. John died by 5 September 1763 when his wife Christian in named his admx. See deed later. The only known children of John & Christian Waters were:
  • 1. John Waters, Jr. moved to Estill County, Kentucky where he filed for an R.W. Pension in 1732.
  • 2. Robert Waters married Margaret Galloway and died in Pr. William County, Va. in 1805. He left a will. There may have been other children in this family that are unknown to us at this time.

5 Sarah Waters was born c 1722 . She married William Tacquett before 1744 and both were witnesses to the will of Philemon Waters I and were the ones who presented the Waters will into court in June 1753. Sarah died in November 1756. She and William had 3 children who lived to be grown.1. Elizabeth Tackett born c 1744. She married Lewis Reno. 2. William Tackett, Jr. born c 1746. He married Fanny Reno. 3. Mary Tackett born c 1748. She married Mr. Hodges. William Tackett, Sr. married 2. Elizabeth Stamps. They had one child Lewis Tackett born c 1768. Below is the will of William Tackett, Sr. Sarah Waters Tackett left a will when she died in November 1756, but it was among the many papers lost or destroyed in Prince William County.

6 Lydia Waters was born 16 April 1720 in Stafford County, Virginia. She married Martin Hardin. They left Prince William County and moved into the Monogehelia Valley. Martin died here. Their descendants moved on into Kentucky and from this family came 3 governors--2 of Kentucky and one a governor of Louisiana.

In the name of God Amen. I, William Tackett of Pr. Wm. County & Parish of Dettingen being in perfect health of body & perfect mind and memory Thanks be given to God calling into mind the mortality of my body and knowing that it is appointed once to die and after that the judgement, do make & ordain this my Last Will & Testament. First of all I desire & commend my soul to the care & protection of the Almighty God my worldly goods as follows.

Item---I desire that my wife Elizabeth Tackett have one half of the house I now live in. The third of my land and orchard, one feather bed and furniture, one sorrell mare, one cow and two ewes, one pot, one large chest & large table during her life & after her death to belong to my son Lewis Tackett.

Item: I give and bequeath to my son Lewis Tackett all my land after my wife has the third of it & half the house I now live in, one negro girl named Pat, one feather bed & furniture, one bay mare and colt, one cow & calf, fore sheep, one sow & pigs, one ____, one desk & six plates to be delivered to my son Lewis when he arrives to the age of Eighteen years & my desire is that my son Lewis Tackett shall have a --(Affrica?) boy by the name of Joseph Buchanan to his own use at my death--further my desire is that I leave one negro woman named Mary and as the rest of my estate except one heafer, one gel ( gelding ?) & ewe I give to my Grandaughter Mildred Reno for the maintance of my wife & my son Lewis Tackett and at the death of my wife the whole to fall to my son Lewis Tackett & the whole I have left him to him & his heirs forever & if he dies without heirs lawfully begotten of his body to be equally divided between my son Wm. Tackett, Mary Hodges & Elizabeth Reno. I further devise that the part of the estate of Thos. Stamps dec'd due me at the death of Mary Stamps his wife I having some part be properly settled by my executors & his and the balance due me to be equally divided between my fore (4) children Wm. Tackett, Lewis Tackett, Mary Hodges & Elizabeth Reno & I likewise ordain, constitute and appoint William Tackett, Jr. & Lewis Reno my sole executors of this my Last Will & Testament. In witness whereof I have set my hand and seal this thirtyeth day of June one thousand seven hundred eighty two.

At a court continued & held for Pr. Wm. County the 8th day of April 1783 the above will was proved.

In 1786 Elizabeth Tackett's Dower was set aside. It appears that young Lewis Tackett had reached 18 years old at this time. The final settlement of the Tackett estate was in 1791, so it is assumed that Elizabeth died at this time

So Philemon Waters I died ca June 1753. By 1768 Catherine is listed as Catherine Smith and makes the following deed.

This indenture made the 26th & 27th day of June in the year of our Lord 1748 between Thomas Walters & Elizabeth his wife of the County of Frederick & Philemon Walters & Sarah his wife of the County of Prince William of the one part and Thomas Wood of the County of Stafford of the other part. Witnesseth that the said Thomas Walters & Eliz. his wife & Phill. Walters & Sarah his wife for the sum of Four Thousand pounds of good tobacco have granted unto the said Thomas Wood ( in his actual possession now by a virtue of a Bargain & Sale for one year & by force of the statute for transferring uses into possession) and to his heirs & assigns forever one hundred seventy-five acres of land being in Pr. William, being part of a greater tract of land taken up by Philemon Waters Senior and by him conveyed to his son Thomas, party to these presents which patent lies in the Proprietors Office and deeds in the office of Prince William, relation being had which said 175 acres of land is bounded beginning at (A ) and two box oaks corner trees to the land granted Morrice Lynah on a ridge and extending from thence along that line that divides this from the land of Gabarcle (Gabriel) Muffit, thence along that line southwest to the line of the said tract of land which this is a part.

500 # of tobacco, south side of Cedar Run in Hamilton Parish, 150 acres, part of a greater track granted Philemon Waters on 15 April 1723, adj. Maurice Lynah. For Mary Askins to have during her natural life, then heirs of her body. Witness was Charles Cornwell and John Metcalf. Signed by Philemon X Waters

  • No record has been found of Philemon Waters, Sr., before 1701 when he appears as an adult (at least 21 years old) in a document on October 24, 1701 in Essex County, Virginia. He is listed as one of the persons transported to America by Mr. William Tomlin. This indicates he must have been born in England ca. 1680.[1]
  • No evidence has been found regarding his parents or exact birth-place. Many family genealogies link him to the William or Thomas Waters family whose ancestor emigrated to Hampton, Virginia, ca. 1620. They were wealthy planters and merchants. However, a 18th Century lawsuit over this family's significant inheritance never mentions Philemon Waters as a son or nephew, making it all but impossible that he was a close relative.[2]
  • Still, Philemon Waters, Sr., was not an indentured servant or a poor man. In 1711, the same year his son, Philemon II was born, Philemon Sr., is mentioned as a landowner in Stafford County. In 1722 he is listed as owning 403 acres on the Cedar Run Branch of the Occoquan River in Stafford County. This was Overwharton Parish where in 1724 Philemon Waters was credited with owning 12,312 tobacco plants, a sizeable plantation. The same document states he had two sons: Philemon II, age 13 (b. 1711) and Thomas, age 10 (b. 1714).[3]
  • Philemon Waters, Sr., married a woman named Mary, Maiden Name Unknown, in about 1708 as his first child, Mary, was born in 1709. She married Edward Askins. Their child, Philemon Askins, was mentioned in a 1730 deed by his grandfather. Mary and Philemon had these children:[4]

  • Mary (Unknown) Waters died sometime after the birth of her daughter Sara, ca. 1728. Philemon married again, this time to his neighbor's widow, Catherine Newport. She would be Executrix of his Will and remarry a third time as by 1768 she was called Catherine Smith in a deed transfer. Philemon Waters Sr. died in June 1753; his Will was proven June 25, 1753 as follows:[5]

"The Last Will & Testament of Philemon Waters, dec'd was presented in court by Catherine Waters, the Executrix therein named who made oath thereto and being proved by the oaths of Sarah Tackett, John Metcalf, and William Tackett the subscribing witnesses is admitted to record and the Executrix having performed what is usual in such cases. Certificate is granted her for obtaining a Probate thereof in due form." Philemon was born about 1680. Philemon Waters ... He passed away after 1753.[6]

Second Prince William Courthouse (Aden Road and MCB 8)
In 1743, the second Prince William County Courthouse was built near here along Cedar Run, replacing the first county courthouse in Woodbridge. After the creation of Fairfax County, the Cedar Run location, owned by Philemon Waters, became the center of Prince William County. The court remained here only until 1759, when it moved to Dumfries after the creation of Fauquier County. Henry Lee, father of Governor Henry ("Light Horse Harry") Lee, and grandfather of Robert E. Lee, practiced law here. The building, like its predecessor, no longer stands. Erected 1992
