Brief overview:
Pieter (51), of Sweetwater Farm, Port Alfred, was shot twice and died, on 19th July 2003. High Court Judge Ronnie Pillay found the suspect, Dean Malgas (22), guilty, and sentenced him to three years correctional supervision.
Malgas, who was 18 at the time, claimed he had shot Fismer twice in self-defence with the deceased's .22 revolver after he thought the man "wanted to use him for sexual purposes". In sentencing Malgas under section 2761(h) of Act 51 of the Criminal Procedure Act, of 1977, Pillay said the crime was not premeditated. Malgas told the court that the two of them had been drinking heavily on the day Fismer was killed.
State advocate Jan Engelbrecht called for a term of direct imprisonment, based on the fact that Malgas had six previous convictions for housebreaking, two for theft, and one for assault. "He has been given suspended sentences, fines and community service and still hasn't learned his lesson", said Engelbrecht. "What happened on the farm that morning we will never know. The two were good friends and had been drinking together. Something happened that soured relations between them," said Judge Pillay.
