He married Eleanor (Wimbley?) also spelled Elinor, the mother of Richard III and possibly other children.
He also had children with his paramour Ann Carver but they were never married. He was still married to Elinor while living with Ann Carver.
About 20 May 1745 (in Edgecombe County, North Carolina), he was arrested for counterfeiting.
The Constable (Hardy Cane) was issued a search and arrest warrant. They first searched the house and found nothing. They next searched the lower room in the storehouse, and then wanted to go up into the loft.
Ann came into the storehouse and told Mr. Cane she would go up first because there was some honey, and he might spill it. the Constable followed right behind her up the ladder. Ann put her foot against a little barrel and slide it away and put something on it. Being suspicious he handed it down to Thomas Price.
They found in there wooden molds, three pieces called Georgia pieces, and four counterfeit pieces in the likeness of Portuguese money, One piece in the likeness of a Spanish piece of eight, and two small pieces in the likeness of Pistereens. Richard and Ann said they knew nothing of the coins and the molds.
Richard paid a fine to the General Court in Edenton equal to $250.00 and was found innocent by a compassionate jury October 1745. If found guilty he would have hanged.[citation needed]
He claimed land in the extreme southern part of Nash Co, NC, on White Oak Swamp. When he divided his property among his sons in 1747 he had over a thousand acres of land and 30 slaves.[2]
