Biography

Richard Kirby practiced Quaker beliefs but never joined the meeting. He refused to take the oath of fidelity in 1658, and was fined 25 shillings for refusing to assist Marshall Barlow the same year. In 1660, he was fined 5 pounds for the same offense, and in October 1660 was one of twenty-four fined 10 shillings each for attending Quaker meetings.

The following excerpt was written in the Dartmouth monthly meeting register of Births, Marriages and Deaths:[1]

Richard Kirbe of Dartmouth departed this life on the 8th day of the first month 1719/20. He was by account in the eighty eight year of his age. He was one that kept generally to friends meetings when able. And lived a quaint life among friends and his neighbors. And in the time of his weakness a little before his departure out of this life [spoke?] to several at several times signifying his willingness to die when the will of the lord was not at all doubting his eternal happiness.

His children were all named in the will of their grandfather, William Gifford. Richard Kirby died testate, having written his will dated 30 January 1707/8, and his will was proved 4 April 1720. The will reads (copied from the Dwight work):

"Will of Richard Kirby, Jun. of Dartmouth, Mass.---To all people to whom these presents shall come, I Richard Kirbey of Dartmouth aforesaid in the County of Bristol, in the Province of the Massachusetts Bay in New England, do hereby manifest and declare that I being sound in my understanding, I have considered the infirmities of my body and knowing it is appointed for all men once to dye, do make this my last will and testament for the disposing of my worldly estate, hereby revoking and declaring null and void all and every other will or wills, testament or testaments by me made whether in word or writing and this is to be taken for my last will."

"Imprs. I will that after my decease, my daughter Temperance Kirbey shall have all my lands, both meadows and uplands, my whole right of lands which I bought of John Wiborn to be and remain unto her my said daughter Temperance Kirbey her heirs and assigns forever. And also a bed and bedding and then a full quarter part of all my personal estate or movables, also ten pounds of money to be payed by my son Robert Kirbey and is due to my heirs and survivors by a bond which the said Robert Kirbey has given me and will be of force after my decease."

"Item, I give and bequeath unto my son John Kirbey and my daughter "....." Meshior wife of John Meishor and daughter Sarah Merihewwife of Samuel Merihew all the rest of my personal estate or moveables that is not before disposed of to be equally divided amongst these three. Allso five pounds a piece in money to be payd by my son Robert Kirbey five years after my decease, that is to say, the money and the moveables or personal estate to be ..?.. at my decease, and the money is due to my survivors as I shall order or appoint from my said son Robert Kirbey as is mentioned in the aforesaid bond."

"Item, I give to my grand-daughter Remember Potter fifty shillings in money to be payud five years after my decease by my aforesaid Robert Kirbey and is part of the money expressed in the bond aforesaid."

"Item, I give and bequeath to all the rest of my grand-children that are living at my decease, five shillings a piece to be payed also five years after my decease by my said son Robert Kirbey of the money mentioned in the said bond. And all the rest and residue of them money contained in said bond, be it more or less, I give and bequeath unto my said son Robert Kirbey whom I make my whole and sole executor of this my last will and testament."

"In Witness whereof I, the said Richard Kirbey have hereunto sett my hand and seal the thirtieth day of January 1707-8. [his mark]

"Signed, sealed, published and declared by the aforesaid. Richard Kirbey, in presence of us, George Cadman, Peleg Tripp, William White"
