• ' "In the name of God amen ye 17th day o August 1665 I Samuell Winsley of the town of Salisbury in ye County of Norfolk Massechusets in New england being in good health & of pfect memory (prayse be given to god for ye same) & knowing ye uncertenty of this life on earth, & being desierous to settle things in order doe make this my last will & testament in manner & forme following: That is to say first & principally I comend my I comend my Soule to almighty god my Creator, assueredly beleiving that I shall receive full pardon and free remission of all my Sinns & be saved by ye pr'sious death & meritts of my blessed Savior & Redeemer Christ Jesus, & my body to ye earth from whence it was taken, and as touching Such worldly estate as ye Lord in mercy hath lent mee My will & meaning is ye Same shalbe imployed & bestowed as hereafter by this my will is expressed, And first I do revoke, renounce, frustrate, & make voy'd all wills by mee formerly made & declare & appoint this my last will & testament : Item I give & bequeath : (my debts being first payd) unto my brother Nathanell Winsley forty pound: but in case he dies w'th out childeren | |or child| | then to returne twenty pound to my Sister Weeds childeren & to put in security: by his bond to pforme the same It: I give unto my brother Elisha winsley twenty pound Item I give unto my sister weed ten pound & to each of hir childeren five pound: & Item I give unto Judeth Bradbury five pound, It I giue unto my Cosen Sam: fowlers Son Samuell three pound: & unto his daughters Mary & Sary fowler twenty shillings each of them: Item my meaning is that my Executo'r here after named shall pay all the legasies by this my will bequeathed w'thin one yeare after my decease : & the one halfe of my brother Nathanells legasie not untill two years after my || mothers || decease: Also I do forgive & release unto my Cosen Sam : ffowler : w't debts soever he doth owe unto mee, Also my will is that if my Mothers estate should fall short of maintaineing of hir So that she should come to want then my will is y't my Executo'r shall pay hir tenn pound: Item I do give my house & all my land to my loveing brother Ephraim Winsley: Whom I do make my Sole Executo'r: of this my last will & testam't: It my will is that if my brother Ephraim die w'thout any heire of his body lawfully begotten that then my house & land: shalbe divided, the one halfe to ye childeren of my Sister weeds childeren; or ye vallu therof : one halfe of ye said halfe: or ye vallu therof unto Sam : Weed ye Eldest Son. & the other halfe of my Said house & land unto my brother Nathaniell & my brother Elisha: my meaning is y't my brother Elisha winsly shall enjoy the house & land paying ye vallu of ye one half therof to my sis — weeds childeren as aforesd & ye vallu of one quarter of ye said house & land unto my brother Na[tha]nell: Wittness my hand & Seale ye day & yeare above written."

• John Weed of Amsbery, planter, and wife Deborah (her mark) acknowledged receipt, in May, 1667, of Ephraim Winsley, executor of the 'will of Sam'll Winsley of Salisbury, deceased', a legacy of £10 given to said Deborah, £4 of it being paid in a bed, rug and chest, and £6 in good neat cattle. Dated Feb. 13, 1670. Witness: Tho: Bradbury and Jabez Bradbury. Acknowledged by both Feb. 13, 1670, before Robert Pike, commissioner. Norfolk County Court Records, vol. 2, page 199.
• Sam'll Weed receipted for legacy of £5 from estate of 'his uncle Samuel Winslo, deceased', paid by his father Weed, Apr. 10, 1674. Acknowledged in court at Salisbury Apr. 14, 1674. Norfolk County Court Records, vol. 2, page 336.

Biography

Samuel Winsley was baptized at Saxmundham, England on November 19, 1626, eldest son of Samuel and Frances (Elmy) Winsley. [1]

His father came to New England in September, 1638. [1] It is assumed that he brought his three children, including Samuel Jr. with him.

Samuel Jr. was appointed executor of his father's estate October 13, 1663 and was ordered to satisfy widow Anne Winsley according the the marriage agreement made in October, 1657. as 'far as the estate will go'. [2]

Samuel Jr. wrote his will on August 17, 1665. He died unmarrried by April 9, 1667 when it was proved. [3] [4] [1]

In his will he left the his lands to his brother Ephraim, whom he named as executor. He left other bequests to:

brothers Nathaniel and Elisha
sister (Deborah) Weed and her children
Judith Bradbury
cousin Samuel Fowler and his children
his (step) mother [3] [4]
