AA No 36, Sarah Daniell's last will and testamnet.

In the name of God Amen. I Sarah Daniell of Berkley County in the Province of South Carolina widow being weak in body but of sound and perfect mind & memory praised be given to Almighty God for the same, to make and ordain this to be my last will and testament in manner and form following.

First, I bequesth my soul into the hands of Almighty God hoping and believing the salvation of the same through the merits of my blessed Saviour and Redeemer Jesus Christ and my body I committ to the earth to be decently buried at the discretion of my hereinafter named Executors being full and certain hope of a resuraction to Eternal life and for my estate which it hath pleased God to have bestowed on me in this world I do give and dispose of the same as follows. Imprimis.

  • I will that all my just debts and funeral charges be first paid and discharged.
  • Item. Whereas I am seized in fee of a lott of land on Charles Town bay near Cravens Bastion containing one hundred foot front the quantity of feet backwards uncertain; now I do hereby give devise and bequeath all that my said lott of land to my youngest son Marmaduke Daniell to his heirs and assigns forever.
  • Item. I do also give & bequeath to my said son Marmaduke Daniell four of my negroe slaves, to say two boys Cupid & Cyrus and one negro woman named Susanna and her girl named Amorett to be delivered to my said Son Marmaduke his Executors Administrators & assigns when he shall attain to the age of one and twenty years, and in case the assembly of this province should pass any law to oblige the owners of the front lotts to build a front wall before their said lotts. If then my son Robert Daniell his Executors or Administrators shall at his or their own proper costs and charges build the front wall before the said front lott, hereby given to his said brother Marmaduke Daniell freely without any payment or reward for the same, and oblige himself by sufficient bond or obligation to his brother Marmaduke Daniell to do and performs the same, and shall also pay unto Mrs Mary Johnson that now lives with me the sum of fifty current money of this Province on demand and I also give to the said Mary Johnson all my waring apparell, linnen & and outside cloaths.
  • I also give devise and bequeath to Mrs Elizabeth Doggitt, Senr the sum of fifty pounds curr money of this Province to be paid her within one year after my decease.
  • And if my son Robert Daniell shall build the said front wall, and pay & discharge the said mentioned legacy's according to the intent and meaning of this my last will then in such case and not otherwise, I do give devise and bequeath to my said son Robert Daniell his Executors Administrators and assigns all my other negroes and slaves, all my cattle horses and Stock of all sorts, with all the materialls belonging to the Plantation and all my household goods and plate.
  • And I do also give to my son Robert Daniell, one diamond ring containing three large stones and four sparks, one pair of diamond earrings one stone in each and one gold Seal which I leave in possession of Sarah Rhett Junr. and shall not be delivered to him until he marries and in case he should never marry then I give the above mentioned diamond Ring, Earrings and gold seal to my son Marmaduke Daniell and in case they should both die unmarried, then I give, devise and bequeath the above mentioned Ring, Earrings and gold seal to my sister, Mrs Ann (Schadley), my sister.
  • I also order and appoint my Executors to give to Doctor Nicholas Trett and his wife, Coll (possibly Col) Wm Rhett and his wife and Mrs Elenor Wright each of them a funeral ring.
  • I further order and appoint thet my son Marmaduke Daniell shall pay out of his part of his estate the charges of his maintance clothing and schooling in England according to an agreement made between his master William Rhett Junr and myself
  • My will further is, that in case my son Robert Daniell & Marmaduke Daniell shall both die without issue lawfully begotten of their body's then in such case I do give devise and bequeath all my real & personal estate whatsoever being or laying of what nature or kind forever to my said sister Ann Schudlay (sp) her heirs and assigns forever.
  • I do hereby appoint Mr. Wm. Rhett Junr and my son Robert Daniell Executors of this my last will and testament hereby making null and void all former wills by me heretofore made, and I do declare and appoint this to be my last will and testamnet contained in four sheets of paper.
  • In witness whereof I the first above named Sarah Daniell have set my hand to every sheet of paper and my seal to the label fixed upon the top of this twnety eight day of July in the Seventh year of the reign of our Sovereign Lord George by the Grace of God of Great Britain France and Ireland, King Defender of the faith ---. And in the year of our Lord one thousand Seven Hundred and twenty one.

Signed sealed published and declared by the above named Sarah Daniell to be her last will and testamnet in the presence of us. Geo Logan, Thomas Cooper, Martha Logan, Sarah Blakeway.

At a council held at the Council Chamber in Charles Town Febry the 8th, 1721. The foregoing will was then proved by the oaths of Thomas Cooper, Martha Logan and Sarah Blakeway witnesses thereto and letters Testamentary granted to Mr. Robert Daniell one of the Executors therein appointed on his taking the oath of an administrator to him in Council; the other Ex Mr. William Rhett being absent from the Province.
