"WILL OF WILLIAM DAVIS"
"In the name of God, Amen. I, William DAVIS, of the State of
Kentucky, Hopkins County, being weak in body but of sound mind and memory and
calling to mind the mortality of my body and knowing it's appointed for all
men once to die, I do make and constitute this my last Will and Testament.
I first recommend my soul into the hands of Almighty God that gave it
my body to be buried in decent Christian Burial nothing doubting I the same
in the morning of the Resurrection. And touching such worldly stuff as
wherewith it has pleased God to bless me with in this life, I give and
bequeath to my dearly beloved wife Anne DAVIS all and singular possession to
be by her enjoyed during her natural life and after her death to be disposed
of in the following manner also (to wit).
To my son Vincent F. DAVIS the tract of land I now live on and to
Jacob B. DAVIS the land which I have now purchased from SMITH being one
hundred acres and the money and note I have in possession both amounting to
one hundred and five dollars. And to my Daughters Betsy, Polly, Rebeccah,
Katherine and Hannah the beds and all the clothing and cupboard ware and all
the rest of the property to be equally divided among all the children Jacob
as well as the rest. I also give and bequeath to my three grandchildren
James, Irvine Luming, and Polly R. FRANKLIN fifty acres of land I took up on
Pond Creek.
And lastly do I appoint my friends and dear sons William P. DAVIS and
Vincent F. DAVIS Executors of this my last Will and Testament hereby revoking
all other or former wills or testaments by me heretofore made.
I witness whereof I have herewith set my hand and affixed my seal this
15th of August 1834."

"CODOCIL"
"I William DAVIS of the County of Hopkins and State of Kentucky do
hereby make and publish this Codocil to be added to my last Will and
Testament in manner following, to wit:
Whereas in my said Will I have given and bequeathed unto Jacob B.
DAVIS a certain note and some money which I then had on hand both amounting
to one hundred and five dollars he having received the same. He is entitled
to the property in his part first heretofore devised to my children and him.
And lastly it is my will and desire that this my present Codoc
annexed to and made a part of my last Will and Testament aforesaid.

This Will and Testament of William DAVIS, dec'd, together with
the Codocil thereto was produced in Court and said last Will and Testament
was proven to be such under the oath of John W. Rash a subscribing witness
thereto and the said Rash further made oath at the time of the execution of
said will by said Decedent. Charles Bradley now deceased was present a
also subscribed his name as a witness thereto. And the said Codocil was
proven by the oaths of Benj'n L. Todd and Martin Sisk subscribing witnesses
thereto. Whereupon the said Will and Codocil were ordered to be made of
Record as the last Will and Testament and Codocil thereto of said decedent
whereupon the same is recorded accordingly.
