33. Sergt. Benjamin 3 Pierce (Thomas 2 , Thomas 1 ) ; m. 10 (8), 1688, Mary Reed, b. Oct. 15, 1670, d. June 17, 1746. He d. Sept. 25, 1739, in Woburn.

Mary Pierce of Woburn, Mar. 10, 1739, admit, admrx. of Est. of her late husb., Benjamin Pierce, late of Woburn, dec'd, int.: giving bonds in £1500, with Samuel Richardson and Thomas Belknap, husbandmen, all of Woburn. Inventory of estate taken 20th, and presented 24th Mar., 1739-40, amounting to about £325 (land £195), apprized by David Wyman, Thomas Belknap and James Proctor. Mary (no date) declares the estate insolvent. Thomas, Sept. 30, 1740, "one of the heirs, complains of improper administration, after hearing on Oct. 6, the Judge was of the opinion that the inventory ought to be amended " so as to include property not taken account of.

105. Thomas 4 Pierce (Benjamin 3, Thomas 2, Thomas 1), b. Nov. 23, 1702 ; m. Nov. 5, 1722, Hannah Locke, b. July 11, 1701, d. bef. Jan. 24, 1743, for at that time he m. 2nd, Lydia Gibbs. He d. Mar. 10, 1768. He first went to Leicester, then to Hopkinton. His wife was admitted to the church in that town in 1730, by letter from the church at Leicester. In 1747, he resided in Framingham. Thomas Pierce of Framingham, yeoman, advanced in age (will, Feb. 22, 1768, pro. Apr. 5, 1768), names his w. Ledy (Exec), his children, viz: Jonathan, John, Elizabeth, Mary, Martha, Mehitable, his s. Thomas, his s. Benjamin, the heirs of his s. Timothy dec'd, his s. James, his d. Hannah Ballard, his dau. Hephzibah Dolby (Dolbier). Agreement of children and heirs signed by Mary Pierce, Thomas, Martha, Jonathan, John, Elizabeth (all Pierce), Hannah Ballard, William Ballard, Hitte Pierce. John (over 14) was put under guardianship Apr. .5, 1768.

A very singular error was five times repeated on the Middlesex Probate records in 1747, where guardians were appointed to the children, of the first wife, her father having deceased, leaving the children property. In the records of the appointment of guardian, it is recited that they were " the children of Thomas Pierce, late of Framingham, deceased," when in fact he did not die till twenty-one years after. It was the wife who had "deceased."
