Here are a couple of records my wife found on Family Tree Maker CD174, Virginia Vital Records #1, 1600s-1800s. 1. "Payne Records from Westmoreland County, Communicated by Mrs. J. C. Pollard Wesmoreland County. Book 7, page 354 Indenture between William Payne Jr. and Francis Aubrey July 25, 1722. For 100 acres, part of a patent granted to John Payne, grandfather to the aforesaid William J. for 400 acres, and by the said John's will bequeathed to John Payne, father to the said William Payne Jr., and by his last will and testament given to his two sons John Payne and William Payne Jr." [This record is in the same Westmoreland County book (7), which several have quoted concerning Elizabeth Poindexter (Payne)'s power-of-attorney letter. This record shows that William Payne Jr.'s father was named John Payne and his grandfather was also named John Payne. It also shows that William Payne Jr,--who married Elizabeth Poindexter--had a brother named John Payne.] 2. "Records of Hanover County Sept. 4, 1735.--James Overton to David Cosby, North Fork of Elk Creek. Rule X Shrewsberry, Elizabeth X Shrewsberry adm. of Wm Payne & Jno Snead & Anthony Pouncey." [This record shows that Elizabeth Poindexter's husband died and she remarried before September 4, 1735.]

Know all men by these presents that I Elizabeth Payn, the wife of William Payn, late of Westmoreland, now of Hanover County have and by these presents doe authorize and impower my trusty and Wel-beloved friends Mr. William Sturman and Mr. John Aubrey, or either of them, to appear at the County Court of Westmoreland aforesaid and relinquish my right of dower and thirds of in and unto One hundred acres of land lying in the said county, sold by my said husband to Mr. Francis Aubrey and for so doing this shall be my Attorneys or Attorney sufficient Warran Given under my hand the 26th day of July Anno. Dom. 1723 "Elizabeth Payn (seal) sealed and delivered in the presence of John Poindexter, Sarah Brechin" Westmoreland Sc. July the 31, 1723. This power of attorney was duely proved in Open Court by the Oaths of the Witnesses and the dower therein mentioned relinquished by William Sturman and admitted to record, and was entered thereon the eighth day of August, 1723.

Justice in the Commission of the Peace for Hanover Co. in the sum of L100 Sterling, 4 Sept. 1735. Condition: if above bound Rule Shrewsbury and Elizabeth Shrewsbury Admr. of William Payne dec'd. do make or cause to be made a true and perfect Inventory of the goods, Chattels and credits of the sd. dec'd. and if it shall hereafter appear that any Last Will and Testament was made by the sd. dec'd. to have it allowed and if required to render up their Letters of Administration then this obligation to be void. Oh, by the way---did you know that our Paynes were Quakers from about 1700 through about the time of the American Revolution? Prior to that, they were with the Church of England. Barb

There is a John who is connected with William [see Wm #1 above] who bought land on the branches of the Dan River with Wm Sr.& Wm Jr. as witnesses. Poindexter Payne are also tied of with this bunch.

Thomas with wife Yanake/Anica who first appears in Hx Co in 1760 where he , William Payne and Nathaniel AYERS laid a road. Yanake's maiden name was Ayers. Thomas moved to Wilkes Co [NC, I think, but maybe GA] in 1778. Will of Nathaniel Ayers of Halifax Co 1777 mentions Daughter Yanake Payne.

Please note names Shrewsbury and Poindexter and refer to Elizabeth Poindexter Payne Shrewsbury in genealogy above of family of John Payne of We Co. It's my thought that William Sr.[with Ruth] , John and Thomas [with Yanake] were brothers and sons of Wiliam Payne and Elizabeth Poindexter of Hanover Co. m(From Elaine Paine)
