WILL OF JOHN SIMPSON In the Name of God Amen: I John Simpson of Brunswick Parish in the County of King George being in perfect senses and memory do make and ordain this my Last Will and Testament. Item: I give to my son Abraham Simpson one suit of cloaths, one cow and calf which was formerly called his and one small gun and sword. Item: I give to my son Francis Simpson one suit of good cloaths. Item: I give or lend all my whole estate to my Loving Wife Mary Simpson so long as she remains my widdow, for the maintenance and bringing up [of] my small children but if she should marry again then my will and desire is that my estate may be equally divided amongst my wife and children or at her death to be equally amongst my children. Lastly I do here nominate and appoint my brother William Simpson and my Loving Wife Mary Simpson Executor and Executrix of this my Last Will & Testament whereof I hereunto set my hand and seal this tenth day of January 1744/5.

At a Court held for King George County on Friday March 1st 1744/5. The Last Will & Testament of John Simpson, Deceased, was presented into Court by William Simpson his Executor who made oath thereto and the same was proved by the oaths of Burton Milligan and Sam- Angell& admitted to record, the said William Simpson with John Pattison entred into Bond in the sum of One Hundred Pounds for the same. Mary Simpson his Widdow & Relict came into Court and declared her refusal to stand to her said husband's will whereupon it is ordered that the said Executor account with her for her part of the said estate according to law. Item: I give to my son Samuel Simpson three head of cattle and all my wearing cloaths, one short gun, one young mare called the Black mares colt and five hundred pounds Crop Tobacco. Item: I give to my daughter Margaret Defton five hundred pounds Crop Tobacco and two young heifers, two barrells of corn and one bushell wheat. Item: I give to my son in law James Payton three head of cattle. Item: I give to my son in law Evan Payton three head of cat- Item: I give to my wife Dianna Simpson all my land during her life for the raising and bringing up my small children and after her decease to be sold at publick auction and the money to be equally divided betwixt my son Samuel Simpson and my daughter Margaret Daflin (sic) and my two sons in law James Payton and Evan Payton. Item: I give to my wife and the rest of my children Dianna, Sarah, Bershaba, William, Joshua, Esaw & Nancy all the rest of my estate not before mentioned to be equally divided amongst them at my wife's death. My will and desire is that there shall be no appraisement of my estate nor no security given for it. County of Stafford of one part & WILLIAM SIMPSON and TRIPHENA his wife .. of other part for diverse good causes but especially for yearly rents hath Leased unto William Simpson and Tryphena his wife .. being the Plantation whereon said Simpson now dwells on North side of Patomack Creek & is bounded .. beginning at lower end of Holland Point Marsh at a marked Seecamore .. running Westly up Potoniack Creek to marked red oak standing about the middle of CHARLES WOODS marsh .. Northerly along Ridge to Capt. PEARSONS CHURCH ROAD thence along the Church Road to Tobaccobed Swamp .. to ffirst beginning .. containing 200 acres unto them .. during the term of their natural lives or longest liver .. doth oblige themselves to pay yearly the just and full quantity of 750 pounds of good Tobacco in Cask upon the said Plantation the 2nd day of .January .. oblige themselves sometime before the end of three years to plant 100 apple trees at 24 foot distance between each tree & also to keep them in a goad tite fence and also to trim .. not to make no west of timber excepting what Tobacco hoggsheads contains the Tobacco made upon the said plantation ..
