Amos Vandeventer and Benjamin Vandeventer complain of Emillia Vandeventer, Andrew Lowe, Elizabeth Lowe, Jane Lowe, Ruth Goodwin, James Goodwin, Ellen Lavfavre and Daniel Lafavre, and say that one Josiah Vandevener departed this life intestate at the County of Morgan sometime in the year 1850 the owner in fee simple of the north half of the southeast quarter of Section 8, and the west half of the southwest quarter of Section 9, all in Township 10 North in Range 1 West. That the said lands descended to and were owned in fee simple subject to dower by the following named persons who were the children and descendants of deceased and such are the only heirs of the said decedent to wit:

  • (1) Amos Vandeventer and
  • (2) Benjamin Vandeventer, the petitioners herein;
  • (3) Ruth Goodwin formerly Ruth Vandeventer but now the wife of James Goodwin;
  • (4) Ellen Lafavre formerly Ellen Vandeventer but now the wife of Daniel Lafavre;
  • (5) Elizabeth Lowe, Rebecca Lowe and Jane Lowe, each of whom are minors and children of Mary Lowe now deceased who was the wife of Andrew Lowe and daughter of the decedent, Josiah Vandeventer;
  • (6) John Vandeventer;
  • (7) William Vandeventer;
  • (8) Josiah Vandeventer, Jr.;
  • (9) Matilda Goodwin formerly Matilda Vandeventer, but now the wife of Josiah Goodwin; and
  • (10) James Vandeventer. And the decedent also left surviving as his widow Emillia Vandeventer who has and holds her dower in the aforesaid lands,
that petitioners since the death of their  said father have in addition to the share that they each inherited in said lands purchased and now hold jointly by deeds the interest of each of the following named heirs in and to the aforesaid land to wit: John Vandeventer, William Vandevetner, James Vandeventer, Josiah Vandeventer and Matilda Goodwin, wife as aforesaid of Josiah Goodwin.

That petitioners now jointly own seven undivided tenths of said lands subject to dower as aforesaid and that the remaining undivided three tenths of said lands are subject to dower also and belong to the aforesaid heirs to wit: Elizabeth Lowe, Rebecca Lowe and Jane Lowe, grandchildren of the decedent, Ruth Goodwin, wife of James Goodwin, and Ellen Lafavre, wife of Daniel Lafavre. Petitioners make each and all of the following names persons defendants to this their said petition to wit: Emillia Vandeventer, widow; Andrew Lowe husband of Mary Lowe, deceased, formerly Mary Vandeventer; Elizabeth Lowe, Rebecca Lowe, Jane Lowe; Ruth Goodwin, James Goodwin' Ellen Lafavre and Daniel Lafavre.

Petitioners further say and charge the truth to be that all of said defendants are adults except the said Elizabeth Lowe, Rebecca Lowe and Jane Lowe who are each under the age of 21 years. And finally, petitioners ask that commissioners may be duly appointed to set off and assign to the said Emillia Vandeventer her dower interest in said lands and that said commissioners may also set off and assign by metes and bounds in one body their aforesaid interest of seven tenths in the lands aforesaid subject to dower as aforesaid and that the remaing three tenths be also set off in one tract of metes and bounds to the owners thereof to wit: Elizabeth Lowe, Rebecca Lowe, Jane Lowe, Ruth Goodwin, wife of James Goodwin, and Ellen Lafavre wife of Daniel Lafavre, and that the same also be subject to dower. And petitioners also ask for judgment of partition and assignment of dower and such other, further different and proper relief as they may be entitled to in the premises.
