Last Will and Testament of Thomas Cannon, dated 2nd March 1799

I Thomas Cannon the elder of Westcott in the Parish of Waddesdon and County of Bucks Yeoman do make publish and declare this my last Will and Testament in manner and form following (that is to say) in the first place I give and devise unto my two sons John Cannon and William Cannon All that my Messuage or cottage situate in Westcott aforesaid now divided into two Tenements and in the occupation of them my said Sons with the Outhouses Yards Gardens and Appurtenances thereto belonging And also all that my Close of Pasture Ground called Leech Close in Westcott aforesaid which I purchased of the late Mr William Hitchcock of Warmstone with the Appurtenances thereto belonging To Hold the same Messuage or Tenements and Close unto the Use of my said two Sons John Cannon and William Cannon their Heirs and Assigns for Ever as Tenants in Common and not as joint Tenants. In the next place I give and devise unto my two sons Thomas Cannon and Joseph Cannon All that my freehold Estate consisting of a Messuage in three Tenements and about six Acres of Meadow or Pasture Ground situate at Westcott aforesaid and which I purchased of Mr Watkins with all the Rights Members and Appurtenances thereto belonging to Hold the same Estate unto the Use of my said Sons Thomas Cannon and Joseph Cannon their Heirs and Assigns for Ever as Tenants in Common and not as joint Tenants. Next I give and bequeath unto my daughter Mary the wife of John Sharp the sum of twenty-five Pounds And to each of my Grandchildren John Thomas and Joseph Saunders the Children of my late daughter Elizabeth the Sum of five Pounds Which saif Legacies or sums of money I do direct shall be raised out of my personal Estate and paid to the said Legates respectively in lawful Money of Great Britain by my Executor hereinafter named within twelve calendar months next after my Decease unless it shall happen that my said three Grandchildren or either of them shall not have then attained the Age of twenty-one Years in which Case I do direct that the Legacy or Legacies of him or them who shall not have attained that age shall be paid when he or they shall respectively attain such age. Next I give and bequeath unto my said two sons John and William Cannon All my flock and stock of sheep and lambs that shall be usually feeding and depastured in the Common Fields of the Parish of Quainton in the said County of Bucks at the time of my Decease and do direct that the same be equally divided between said two last mentioned Sons as soon as conveniently may be after my Decease And as to all the rest and residue of my ready monies Securities for Money Household goods and Furniture and Implements of Household Stock of Horses Cows Sheep Pigs corn Grain and Hay Farming Stock and Utensils in Husbandry and all other my personal Estate and Effects whatsoever and wheresoever that I shall be possessed of or intitled to at the time of my Decease I give and bequeath the same and every part thereof unto my said Son Joseph Cannon his Executors Administrators and Assigns to and for his and their own absolute Use and Benefit Subject nevertheless to and chargeable with the payment of all my just Debts and Funeral Expenses the several Legacies herein before me given the Charges of the probate of this my Will and of the Executorship And Upon Trust that my said Son Joseph do and shall permit and suffer my dear wife Sarah Cannon and her assigns to have receive and take the clear increase Produce and Profits of all the said residue of my Stock of Cattle and Farming Stock during so long time as she shall continue my widow and unmarried or otherwise at the Election of my said dear wife do and shall pay to her or her Assigns weekly and every week during the time aforesaid the sum of ten shillings of lawful money of Great Britain clear of all charges and Deductions whatsoever on the Saturday in every week And in Case my said Son Joseph shall for the space of One Calendar Month after my Decease or at any subsequent time or times refuse to permit my said wife to receive the Increase Produce and Profits aforesaid or to pay her the said weekly sum if she shall so elect Then I do hereby give and bequeath all the said rest and residue of my personal Estate (so given and bequeathed to my said Son Joseph) after payment of my Debts Legacies Funeral expenses and the Charges aforesaid unto her my said dear wife to hold to her Executors Administrators and Assigns absolutely to and for her and their own Use and Benefit And Lastly I do hereby make and constitute and appoint my said son Joseph Cannon sole Executor of this my last Will and Testament in Testimony whereof I the said Thomas Cannon the Testator have to the first sheet of this my last Wil and Testament set my Hand and to this second and last sheet thereof my Hand and Seal this Second day of March in the Year of our Lord Christ One Thousand and seven hundred and ninety nine.
