Abstract of Samuel Hicks’ Will:

March 7, 1770 proved Nov. 1772

Samuel Hicks of Granville Co., N.C. wills to his wife Diana, the plantation whereon I live for her natural life on west side of Tabbs Creek and all my personal estate for her widowhood but if again married, then to receive 1/3 of estate; after death of my wife, I lend to Jacob Woodal and his wife Agnes for their lifetime on condition they pay quit rents and, after their death, to their son James Woodal; to Agnes Woodal, after my wife’s decease, a feather bed and all thereto belonging and lend to Nathaniel Whitlow and his wife Diana the remainder of the land, viz: from the Great Branch to the back line on condition they pay the quit rents thereon; to Nancy Hicks Whitlow, daughter of Nathaniel Whitlow, a feather bed and all thereto belonging; to David Hicks, son of Samuel Hicks, Jr., a cow and a calf after my wife’s death, and also a rifle gun and one sow; to Bishop Hicks, son of Absalom Hicks (the name also spelled Hix throughout the will), one heifer after my wife’s death; to Solomon Whitlow, the land given to his parents, Nathaniel Whitlow, after death of his parents; all other stock, etc. to be equally divided to Samuel and Henry Hicks, whom I appoint as executors. Absalom Hicks was the son of Samuel Hicks and Diana (Willis) Hicks.

The 1747 List of Tithables in Goochland Co., VA, records three white polls in Samll Hix's household: Samuel Hix, Henry Hix, and Samuel Hix Junr.[1] Absalom had not reached taxable age of sixteen years; therefore, he was born after 1731.

Samuel Hix executed his Granville County, North Carolina, will 7 March 1770, including a bequest: "to Bishop Hix, son of Absalom Hix" [Bishop Hix likely is the eldest surviving son of Absalom]. Testator Hix does not specify his heirs' kinship to him.[2]

An 1832 deposition by Solomon Whitlow, a documented son of Dianah Whitlow Dianah (Hicks) Whitlow, states Absolom Hicks, Sr. Absalom Hicks and Dianah (Hicks) Whitlow were brother and sister.

Solomon Whitlow, son of Nathaniel and Diana (Hicks) Whitlow, aged 70 years on April 22, 1832 [thus born April 22, 1762], gave an affidavit 11 September 1832 in Orange County, North Carolina, Superior Court on behalf of the Revolutionary War pension application of [his first cousin] Harris Hicks, son of Absalom Hicks.[3] Whitlow stated:
"That at about the age of three years [circa 1765] his [Solomon Whitlow's] parents removed from Hanover County in the State of Virginia and settled on Tabbs Creek in the County of Granville & State of North Carolina. That his mother [ Dianah (Hicks) Whitlow ] was the sister of Absalom Hicks who had married and settled in the neighborhood of his father and within about a mile or mile and a half of him – That said Absalom Hicks died and left 3 sons, Bishop Hicks, Absalom Hicks, and Harris Hicks . . . . He also remembers that Harris Hicks performed part of another tour as a substitute for David Hicks his uncle – David Hicks was in service and desirous of going home to his family. A tour of Harris had just expired and he was prevailed upon to take his uncle's place and did so for some compensation but what this affiant cannot remember – The Term of service of Harris in this Tour this affiant thinks was for 2 months."[4] See Harris Hicks's profile for more about his Revolutionary War service.
NOTE: If David Hicks was Harris Hicks's uncle, David must have been the brother of Harris's father Absalom and the brother of Whitlow's mother.
Marriage
Based on the unverified 1756 birth of son Bishop Hicks, Absalom Hicks and Mary Harris married about 1755. Her paternity and marriage are established in her father Sherwood Harris's 1763 will.

Captain Sherwood Harris owned land on Tuckahoe Creek in St. James Northam Parish, Goochland County, Virginia, during the years 1753-1755. [citation needed]
Sherwood Harris's 1763 Granville County, North Carolina, will devises 100 acres to "my loveing daughter Mary Hix whereon her husband Absolom Hix now dwells." Harris forgave "my loveing Son in law Absolom Hix" a debt that Hix owed Harris.[5]

Sometime before 22 October 1764, Samuel Hicks Sr. and wife Dianah and Absalom Hicks and wife Mary migrated to North Carolina.

22 October 1764, Granville County, North Carolina, deed book G: 281-282, Robert Harris, Snr. Esquire, brother and executor of the estate of Captain Sherwood Harris Snr., for £15 Current Money of Virginia conveyed 100 acres to Samuel Hicks Snr. The land was located on Tabbs Creek, Granville County, NC. Witnesses: Absalom Hicks and [Absalom's wife] Mary Hicks.[6]

The two Samuels and Absalom "were listed again in 1770, but in 1771 Mary Harris Hicks replaced her husband, Absalom Hicks, who died March 1770." [citation needed]
Death
Absalom Hicks executed his will 8 February 1770 in Granville County; the consistency of handwriting indicates he wrote it himself. He nominated three executors: "Jacob Waddull" [brother-in-law Jacob Woodall], Sherwood Harris, and his wife Mary. Absalom was dead before April 1770 when two of the executors qualified at Granville County Court: Jacob "Woodell" and Mary Hicks.

In the name of god amen the eight day of febernary 1770 I Abslom hiks being Sick of body but being perfect in memory and calling to remmembrance the uncertainty of life and certainty of death, I do make constitute and ordain and declare this my last will and testment in manner and forme folloune I lend and bequathe my whole estate to my wife after the paying of my just debts and funnral charges as long as She remains in weddowhead and if She Shall mary a Second husband She Shall have equll pairt as wan [one] of the rest of the children, being in life at the time of the marrage. I choose and appoin Jacob Waddull and Sheerat herris and my wife as execcetors to Sell and make mony of my estate and that the Same be devided in equll parts among my wife and children and if She remain in weddowhead She Shall have right to mannage my estate as Soole [solel] tutor and execcketor the time of her life Signed and Sealed Abslom hiks

Children of Absalom and Mary (Harris) Hicks
Bishop Hicks born circa 1756. Dave Ashcraft: "The oldest known child to me thus far was Bishop Hicks born 1756 whose year of birth is calculated from his age that is given in the Granville Co., North Carolina Orphans Courts Records wherein Bishop Hicks and his brother Harris Hicks {my direct line} are assigned by the court to others so that each may be taught a trade."[10] 21 November 1771, Granville County, North Carolina, Bishop Hicks, orphan of Absolem Hicks, bound to Thomas Norman to become a taylor.[11] Comment: That Bishop Hicks was bound out four years earlier than his two brothers Harris and Absalom supports that he was the eldest surviving son. His birth year needs documentation; he may not be Absalom's eldest child.

Absalom Hicks born circa 1763-1764. 7 November 1775, Granville County, North Carolina, Absalom Hicks, 12 years old [born circa 1763-1764], bound to Henry Milton to become blacksmith.[15] According to Dave Ashworth, "Absalom Hicks, Jr., born abt 1763, and his brother Willis Hicks, born about 1765, removed to Christian County, Kentucky."[16]
Questionable: Nathaniel Hicks born circa 1758, according to Dave Ashcraft.[17] Solomon Whitlow's affidavit states "Absalom Hicks died and left 3 sons, Bishop Hicks, Absalom Hicks, and Harris Hicks"; no son Nathaniel is mentioned. Nathaniel Hicks was linked to Absalom as a son on 8 January 2014, but no kinship evidence is offered. The link probably should be removed.
Questionable: Willis Hicks born circa 1765, according to Dave Ashcraft, who states Willis and his brother Absalom Hicks Jr. moved to Christian County, Kentucky.[18]. No son named Willis is mentioned in Solomon Whitlow's affidavit.
