About Asher Hinds

ASHER HINDS son of Benjamin and Elizabeth Hinds was born in West Boylston 11 Sept 1759. He grew up in Shrewsbury. He was 5 when his mother died. His father remarried and had 7 more children making a total of 17. His older brothers Daniel, Benjamin, Jason and Nimrod served in the Revolutionary War. Asher was 16 years old when the war started and probably stayed home to help take care of the farm. At the end of the war Asher was 22 and probably was involved in lumbering operations. This was the best way at that time for a young man to make a good living.

Asher's grandfather and several of his uncles could not read and write or even sign their own names. Asher's step-mother Tabitha obviously was a strong believer in education. Two of his half brothers became lawyers and two became book binders. In Asher's later life it was clear that he had a good education.

Some time before 1788 Asher came to Maine and was working in the lumbering Industry. He probably came with his brothers Benjamin, and Nimrod. Benjamin acquired a 300 acre wood lot on the Union River in what later became Trenton Maine around 1786. Asher owned 2 of this lot when he died.

Asher married Rebecca Crosby daughter of Joel and Hannah Crosby in Winslow Maine 6 Sept 1788. Joel and his brothers Jonah and Robert owned and operated one of the first saw mills in Winslow. It was located on the stream that drains Pattee’s pond on the Benton Winslow town line. Most of the lumber near the river had long been cut and gone by 1788. Robert and a few other families started a new community near the pond in what is now Albion around this time. Asher, Nimrod and probably Benjamin settled in this community before 1789.

It was much easier for them to be living closer to the timber that they were cutting for the mill in Winslow. Asher and Nimrod both had children born in Albion from 1789 to 1798.

Asher did well and by 1797 he owned nearly 300 acres in what later became the village of Benton Falls.

Asher was elected to some town office every year from 1798 to 1814, serving as selectman twelve times during that period and tax collector in 1807. He represented the town of Winslow in the General Court of Massachusetts in 1812. He also acquired the title Esquire which was only used for professional men and the most successful businessmen. By 1814 he owned his farm, 3 or 4 wood lots or old farms, an old store, half a saw mill, 3 teams of oxen and various other farm animals and was valued at $4600. He was one of the wealthiest men in the area.

In 1814 an epidemic of diphtheria, then called the black death passed through Central Maine an took the lives of many people. Asher died 19 April 1814, age 54. Rebecca died 10 Nov 1843, age 71. They are buried in the Hinds-Barton cemetery in Benton. Asher died without a will and the Probate Court in Augusta settled his estate. The 3 oldest children (Asher Jr, Benjamin, and Martha) were adults and received there share of the estate within a year of Asher’s death. Rebecca kept the 3 younger girls (Ruby, Thirza, and Elvira) and Rebecca’s cousin Stephen Crosby, who owned the other half of the saw mill, became guardian for the 3 younger boys,(Jefferson, Temple, and Crosby). About a year after Asher died, his brother Nimrod who lived in Skowhegan named his new born son Asher.

                         Judge of the Probate of Wills esc. in said county 

To Ezekiel Brown Jun, Henry Johnson, & David Church Esquire of Clinton and all freeholders in said county Greetings
Pursuant to the power and authority to me given, in and by the --s of the Commonwealth aforesaid, I do hereby appoint and authorize you a committee to appraise all the real estate whereof Asher Hinds late of Clinton Esq deceased died seized and possessed in said County (excepting the widow’s dower, and what may have been legally sold for payment of the just debts of said deceased) each piece and parcel by itself, at the present true value thereof, in money, all in words at length: and if said estate, or any part thereof, lie in common or undivided with the real estate of any other person, you are first to sever and divide the estate of said intestate, from the estate with which it lies in common as aforesaid, giving timely notice to all persons interested, to be present, if they see cause. When you have perfected your inventory, you are faithfully and impartially to divide and make partition of the estate therein appraised, among the children or heirs of said deceased, as the law respecting the descent of intestate estates directs, observing that if any of the children or grandchildren of said deceased have had portions assigned or delivered them by him in his life time, to take such portions into consideration, and deduct the same from their shares in such partition respectively. Moreover, if it shall appear that any messuage, tract of land, or other tenement, shall be of greater value than either party’s part, or share in said estate, and cannot be subdivided, or part thereof assigned to one and part to another, without great inconvenience: you may settle or assign the same to one or more of the parties, and award that the party or parties to whom you assigned the same, pay such sum or sums of money to the other party or parties, as by means thereof may have less than their share. When you go about your work, let all parties concerned have notice: and if any dispute arise about the quantity of any parcel of land, you may procure an artist for the survey thereof : and if all parties be satisfied with your proceedings, let them signify the same by countersigning. You are to be under oath faithfully to perform the said service, and when it is completed, you are to make return of this warrant, with your doings thereon, into the Probate Office for the county aforesaid, as soon as may be. Given under my hand and seal of office, at Augusta, in said county, this tenth day of October A.D. 1815

                                      Commonwealth of Massachusetts Kennebec Co. At a Court of Probate at Augusta within and for said county on Tuesday the 12 of March 1816. The foregoing report being presented to the Honorable Daniel Cony Esq. Judge of Probate for said county of Kennebec, as the division of said real estate of Asher Hinds, late of Clinton, Esquire, deceased intestate, made upon oath by Ezekiel Brown Jr, Henry Johnson and David Church, a committee duly appointed and authorized for that purpose and the Judge of said court having examined and considered the same- It is therefore ordered and decreed that received report be accepted as a new division of the said real estate among the children and heirs of the aforesaid deceased and that these same be recorded, probated however the new report is accepted in the following conditions to wit: That these assignees who abide by the terms of and report are to pay at the said rate of money to others of the assignees therein named herein 
to wit: to pay such sum or sums and interest at the rates of principle contained per agreement  to be paid within one year after by party having right by law to claim the same and the same or part so assigned shall be held charged for the payment thereof.

Commonwealth of Massachusetts Kennebec Co We the in designated the committee in the named warrant mentioned, after having been legally sworn, and having given the notice to all persons intrusted in the former, have promised to the discharge of the duties therein assigned them and now by leave to report, That the late Asher Hinds Esq in the aforesaid warrant mentioned at the time of his decease was taxed & possessed of the following disencumbered real estate to wit: a certain piece or parcel of land situated in Clinton in said county on the East side of the Sebasticook River commonly called the homestead and this sum lot or farm on which the said Asher Hinds Esq resided at the time of his decease, containing about one hundred & fifty acres of land, which said lot of land with it’s appendages (after deducting there from the right to dower heretofore assigned to the widow Rebecca Hinds) We have appraised and estimated at the sum of nine hundred dollars in value. ($900) And also a certain other piece or parcel of land situated in Winslow in said county & bounded as follows to wit: beginning at a pine stump at the north east corner of land owned by Stephen Crosby, then running south eighty degrees east forty one rods, to the south side of mill stream, then south seventy one degrees east on the bank of said stream six rods, then south eighty two degrees east on said bank five rods, then south fourteen degrees east on said bank seven rods, then south thirty five degrees east on the bank of said stream about six rods, then north one rod to the middle of said stream, then up the middle of said stream eight rods, then south fifty degrees west about eight rods to the south west corner of the mill yard, then south thirty three degrees east about twenty rods to the south east corner of said yard, then south sixteen degrees east, twenty three and an half rods to a stake and stones, then south fourteen degrees west eighty four rods to a stake & stones, then west northwest one hundred and twenty two rods to a stake and stones on the easterly line of Stephen Crosby’s land & from there north thirty two degrees east to the first mentioned bounds containing about seventy acres of land which said last described tract of land to have appraised and estimated at the sum of four hundred and twenty dollars in value. ($420)
7 And also a certain other piece or parcel of land situated in said Winslow commonly called the bog lot and bounded as follows to wit : beginning at a hemlock tree at the northeast corner of land owned by Thomas Smiley, twenty nine rods northerly of land owned by Ebenezer Heald, then running west northwest about one hundred and sixty rods to a stake and stones, then north northeast about fifty five rods, then east southeast about one hundred and sixty rods & from there south southwest to the first mentioned bounds. And also a certain other piece or parcel of land adjoining thereto and bounded as follows to wit : Northerly by land of John Drummond, easterly by lands of Ephriam Wilson, southerly by the aforesaid Bog lot & westerly by the mill stream, containing nine acres of land. The two last disencumbered tracts of land contains in the whole, forty two acres and two thirds of an acre of land, and after deducting therefrom the afore said widows rights of dower therein heretofore assigned , we have appraised and estimated the same at the sum of two hundred & ten dollars. ($210) And also the south half of a saw mill in said Winslow standing on land formerly owned by Joel Crosby deceased, with one half of one and an half acre of land, thereto adjoining, appropriated for a mill yard, together with the privilege of a road leading therefrom to the Sebasticook river, and the privilege of occupying one and an half acre of land lying on said river for artisaning & one half of all privileges to said mill belonging which said last described real estate & privileges thereto belonging, after deducting the aforesaid widows dower, we have appraised and estimated at the sum of three hundred and thirty four dollars. ($334) And also a certain building (store) formerly occupied by Messrs. Cony and Barton as a store, standing between the dwelling house and shop of Gersham Flagg in said Clinton, which said last described real estate with the legal rights & privileges there to belonging, we have appraised and estimated at the sum of Fifty dollars. ($50)
And also one pew in the meeting house in Winslow, which we have appraised and estimated at the sum of five dollars in value. ($5) And also a certain lot of land situated on or near the Union River in the county of Hancock and known and described in the original offer of this commonwealth by lot number fifty four in township number twenty, middle division, the whole lot containing three hundred & twenty acres of land, which said lot was drawn by one Benjamin Hinds as the holder of ticket no. two hundred twenty five in the land offer established by laws passed the ninth day of November in the year of our lord one thousand seven hundred & eighty six. One half of which said lot belonged to the said Ashur Hinds at the time of his decease & which we have estimated and appraised at the sum of two hundred dollars in value, ($200) which said real estate as above appraised & estimated amounts in the whole exclusive of the widows dower, the sum of two thousand one hundred & nineteen dollars in value. None of which having been sold since the decease of said Asher Hinds Esq. For payment of his just debts. ($2119)

8 And we the afore said committee would further report that the only heirs at law, of said Asher Hinds, that said committee have been able to discover are the following children of said Asher Hinds Esq. To wit : Asher, Benjamin, Patty, Ruby, Thirza, Jefferson, Crosby, Temple & Elvira, none of which having in the life time of said Asher Hinds Esq had portions assigned or dedicated to them.

Each of said children are therefor entitled to receive out of said estate their respective shares therein in equal proportions which said real estate we have therefore divided into nine equal parts at two hundred & thirty five dollars & forty four cents a share, which we have made partition of & divided among the heirs aforesaid in manner following to wit :                                       Several parts of said real estate in the opinion of said committee cannot without great inconvenience and injury to the occupation of the same be divided amongst said heirs,                        We have therefor appended the division of said warrant, assigned to Benjamin Hinds aforesaid all the above disencumbered real estate commonly called the homestead, except that part thereof heretofore assigned to the widow Rebecca Hinds as her dower therein, reference to said assignment being had for it’s description & bounds and also one undivided half part of the aforesaid saw mill with an equal share of the privileges thereto apportioning as above described to have and to hold the same to the said Benjamin Hinds his heirs and assigns forever, as fully and completely as the aforesaid Asher Hinds Esq held & occupied the same during his life or at the time of his decease, saving and excluding therefrom that part of the same heretofore assigned to the widow as aforesaid. And we have & do hereby assign to Asher Hinds aforesaid the following part of the real estate as above described to wit : all and every part of the Union River lot so called, the aforesaid store and the Pew in said Winslow meeting house and one undivided half part of the above described saw mill and privileges thereto belonging, to have and to hold the same to the said Asher Hinds his heirs and assigns as fully and completely as the said Asher Hinds Esq held and occupied the same at the time of his decease, saving and excluding therefrom the aforesaid widows right of dower heretofore assigned to her in said saw mill & privileges thereto belonging, to have and to hold the same to the said Asher Hinds his heirs and assigns as fully and completely as the said Asher Hinds Esq held and occupied the same at the time of his decease saving and excluding therefrom the aforesaid widows right of dower heretofore assigned to her in said saw mill & privileges. And we have also and do hereby assign to the aforesaid Temple & Crosby Hinds out of the aforesaid estate the whole and every part of the lot of land in Winslow commonly called the seventy acre lot, it being the tract of land in this report secondly above described to have and to hold the same jointly by said Temple & Crosby Hinds their heirs and assigns forever as fully & completely as the said Asher Hinds Esq held and occupied the same at the time of his decease.

And we have also and do hereby assign out of said estate to the aforesaid Jefferson Hinds the whole and every part of the Bog lot so called and the said nine acres of land adjoining thereto as above described, to have & to hold the same to the said Jefferson Hinds his heirs and assigns forever as fully and completely as the said Asher Hinds Esq held & occupied the same vat the time of his decease, saving and excluding therefrom the aforesaid widows right of dower heretofore assigned to her in the same. And we the aforesaid committee do hereby award and order that the aforesaid Benjamin Hinds pay or cause to be paid onto the following known heirs to the said Asher Hinds Esq deceased, the following sums of money, to wit:

                                                                                                                                             9 onto the aforesaid Patty Hinds the sum of one hundred and twenty five dollars twenty four cents, in part of her claim to the aforesaid real estate.                                                                                                                                                                                                                 ($125.24) And to the aforesaid Ruby Hinds the sum of two hundred & thirty five dollars forty four cents in full for all claims she may have to the aforesaid real estate.                                                                                                                                                                                            ($235.44) To Thirza & Elvira Hinds two hundred & thirty five dollars forty four cents each in full for all claims which either of them may have to the aforesaid real estate.                                                                                                                                                                                    ($235.44) And we further award and order that the aforesaid Asher Hinds pay or cause to be paid onto the aforesaid Patty Hinds the sum of one hundred & ten dollars & twenty cents in full of all claims which she may have to the aforesaid real estate.                                                                ($110.20) And to Jefferson, Temple & Crosby Hinds the respective sums of twenty five dollars & forty four cents each, which together with the real estate above assigned to them is in full of all claims which they or either of them may have as heirs at law to said real estate.                                                                                                                                                                           ($25  But it is to be unburdened that this report & the assignments and awards therein made is to have no operation upon the reversion of the widows dower or that part of the real estate of the late Asher Hinds Esq deceased heretofore assigned to her but that the same is to be and remain as though this report has not been made.
