<p>[Philpot1.FTW]</p><p><p></p></p><p><p>John Philpott named him as a brother in his will dated October 16, 1761.</p><p><p></p></p><p><p>He moved from Charles County to Prince Georges County, Marylandwhere in 1767 he gave bond as guardian of his brothers John's orphan sons. There is no proof that he purchased land in this county. However, there is a deed recorded on October 5, 1772 of the sale of land called "Locust Thickett" to Edward Edelen.</p><p><p></p></p><p><p>In 1772 he and his family moved to Frederick County, Maryland where he lived for the remainder of his life. He took the Oath of Allegiance in Frederick County in 1778.</p><p><p>His will was dated July 9, 1804.</p></p><p>He enrolled as a membr of a Compnay of Militia on March 9, 1776 "to fight against whomsoever, upon the Command of the Convention or Council of safety or of their officers."
Barton Philpott was probably born between 1737 and 1740 at Charles County, Maryland. During the settlement of his estate, on 27 February 1806, a deposition was made stating that Barton was "upward of 60 years of age and near 70". He was the 8th child of nine, born to Charles and Elizabeth Barton (Smoot) Philpott. Barton wrote his Last Will and Testament 9 July 1804 at Frederick County, Maryland. The will was probated 27 February 1806. The will designated that six of his children should receive 2/3 of his personal estate. This indicates that these children were the children of his first wife, Martha Musgrove (the seventh child of Martha was already deceased). The other portion of his personal estate went to his second wife, Barbara, who was advised to dispose of the 1/3 share as she thought proper.
