Be it remembered that I, Catharine Hatcher (widow and relic of James Hatcher)of Loudoun County and state of Virginia reflecting on the uncertainty of this life - Do this 20th day of the first month in the year one thousand eight hundred and twenty nine make and publish this my last Will and testament as followeth viz. First, - I do order and direct my executor hereafter named to pay my just debts and funeral expences as soon after my decease as may be. Secondly I do give and bequeath unto the ten children of my daughter Ann who intermarried with a certain Richard Tavenner the sum of f___ hundred dollars to be paid to them in equal proportions that is share and share alike the money paid them is to be taken out of the legacy left me by my brother Sam'l Nichols. Third I do give and bequeath to my eight remaining children namely Mary Gregg wife of Abner Gregg, Isaac Hatcher, Edith Hatcher, Sarah wife of William Spencer, Rebecca Nichols, wife of Swithin Nichols, Elizabeth Young wife of David Young, James Hatcher, and Margery Nichols wife of Jacob Nichols all the residue of my estate to be equally divided between them that is share and share alike to be paid them as soon as may be collected. Fourth I do will and direct that when my household and kitchen property with the Cupboard are appraised that my children afore named have the priviledge of taking such things as they may choose at the price set by the appraisers. Fifth I do will that the proportion of my estate which will fall in my will to my daughter Mary Gregg before named must remain at interest in the County of Loudoun and that for her to receive interest annually during her natural life and after her decease I do will that the principal be equally divided amongst my living children or their lawful representatives and my executor to have the lease thereof. Sixth, I do will that if any of my children should die without an heir or heirs from their body that what I have willed to them to remain in the family and to be equally divided amongst my children or their lawful representatives. Seventh and lastly - I do nominate and appoint David Young and James Hatcher Executor of this my last Will and testament revoking and disannulling all other and former Wills and testaments by me at any time made and this only to be my last Will and testament. In witness whereof the said Catherine Hatcher hath hereunto affixed, signed, Sealed and delivered the day and year first above written. At a court held for Loudoun County Febry 9th, 1829 - A paper purporting to be the last Will and testament of Catherine Hatcher decd was presented to the Court and proved by the affirmations of David Smith, William Gibson, and Thomas Nichols the subscribing Witnesses thereto and ordered to be recorded and on the motions of David Young and James Hatcher exors therein named who made oath as such and together with Rich'd Tavernner, Swithin Nichols, William Gibson, and Joshua Pancoast their securities entered into and acknowledged a bond in the penalty of ten thousand dollars conditioned as the law directs Certificate is granted to them for obtaining a probate thereof in due form. Note on identity other people mentioned in will: Swithin Nichols, Jacob Nichols, and Susanna Nichols wife of James Hatcher Jr, are the children of Jacob Nichols Sen and Tacy West. Jacob Nichols Sen. is the son of John Nichols and Charity Chandler, and a 1st cousin to Catharine NICHOLS Hatcher. William Gibson is a nephew to James Hatcher Sen, son of Mary HATCHER and James Gibson. Joshua Pancoast is a nephew to Catherine NICHOLS Hatcher, son of her sister Ruth NICHOLS and John Pancoast. Thomas S. Nichols could have several identities. He is most likely the grandson of Catharine's brother William Nichols and Sarah Spencer, he had two of them; the son of son Samuel had a middle name of "Janney" and so this Thomas S. is probably the son of Isaac Nichols and Lydia WALTERS. Lydia WALTERS is the daughter to Catharine NICHOLS 1st cousin Diana NICHOLS and George Walters. This Thomas Nichols (30 mar 1802 - 14 Jul 1864) married Emily HOLMES 19 Oct 1826. William Spencer is the son of Nathan Spencer and Hannah LOOFBORROW, and a nephew to the Sarah SPENCER who is the sister-in-law to Catherine NICHOLS Hatcher. Abner Gregg is the son of John Gregg and Ruth SMITH, first a widow of Samuel Sherwood. Abner Gregg's first wife was Sarah SMITH, daughter of William Smith and Ann WILLIAMSON, and the mother of all his children. David Smith ??? Sarah SMITH above had no brother named David and her siblings have gone to Belmont Co OH. A David Smith became an elder of the Goose Creek Friends Church in 1823, and is probably this person, just a friend of the family, and not a relative. Richard Tavenner is the son of George Tavenner & Tabitha ROACH. David Young is the son of John Young and Lois WIATT, and grandson to Hercules Young Sarah PHILLIPS. Samuel Nichols, brother to Catherine, has his will in Alexandria Co VA Will BK 3, p266 and in Loudoun Co VA Will Bk P, p350, 1825. He had no children and left his estate to numerous nieces and nephews and their children.
