The record does not state the place of birth of Charles Witt, but it does state that he lived in Halifax County, Va. and that he married Lavinia Harbour, and that he died in Halifax County, Va. in the year 1781. The will of Charles Witt of Halifax County, Va. is on file in the office of the Circuit Court of Halifax County. The record shows that it was recorded in Halifax in the year 1781 in Will Book I, page 415. This will mentions the wife of Charles Witt as Lavena. It also mentions all of his children, 11, as follows:

Sarah (Kerby), Lavenia (Sullins), Mary (Jonaken), Charity, Elijah, Caleb, Lyddie, Joseph, Nelly, Rhoda, Susannah

The record states that Capt. Charles Witt fitted out the Halifax County Militia of Virginia in 1758, furnishing supplies for which he was paid 12 pounds and 18 shillings. He later served with George Washington. The records of the Virginia Historical Society also show that Charles Witt was a member of the 2nd. Virginia Regiment, his service being terminated by his death in 1781.

Item, I lend unto to my well beloved Lavinia Witt during her natural life or widowhood the land and plantation whereon I now dwellwith all mt stock of every kind also my household furniture of every kind whatsoever,

Item, I give and bequeth unto my son Joseph Witt after the death or marriage of my said wife the above said land and plantation with all my stock of every kind and also the household furniture provided that he my said son Joseph pays off the legacies before bequeth which said land go to be given to my said son and his male heir lawfully begotten of his body forever.

Item, my will and desire is that my son Joseph Witt shall obleige to take care of his mother her life or widowhood also all the small children to keep them togeather with her while they come of age or able to do for themselves.Item, I I order that my executors hereafter named sell all the land I hold on the south sideof the Main Road between that and the Dan River, and the money be applied towards paying my son Calebs legacy off,

and, lastly I appoint constitute and ordain my wife Lavinia Witt Executrix and my son Joseph Executor of this my last will and Testament, hoping they will see the same duky performed and confirming this and no other to be my last will and testament.
